Stat. tit. 10A, § 10A-2-9-104","heading":"Interstate Commission for Juveniles","body":"ARTICLE III\n\nINTERSTATE COMMISSION FOR JUVENILES\n\nA. The compacting states hereby create the “Interstate\n\nCommission for Juveniles”. The Interstate Commission shall be a\n\nbody corporate and joint agency of the compacting states. The\n\nInterstate Commission shall have all the responsibilities, powers\n\nand duties set forth herein, and such additional powers as may be\n\nconferred upon it by subsequent action of the respective\n\nlegislatures of the compacting states in accordance with the terms\n\nof this compact.\n\nB. The Interstate Commission shall consist of commissioners\n\nappointed by the appropriate appointing authority in each state\n\npursuant to the rules and requirements of each compacting state and\n\nin consultation with the State Council for Interstate Juvenile\n\nSupervision created hereunder. The commissioner shall be the\n\ncompact administrator, deputy compact administrator or designee from\n\nthat state who shall serve on the Interstate Commission in such\n\ncapacity under or pursuant to the applicable law of the compacting\n\nstate.\n\nC. In addition to the commissioners who are the voting\n\nrepresentatives of each state, the Interstate Commission shall\n\ninclude individuals who are not commissioners, but who are members\n\nof interested organizations. Such noncommissioner members must\n\ninclude a member of the national organizations of governors,\n\nlegislators, state chief justices, attorneys general, Interstate\n\nCompact for Adult Offender Supervision, Interstate Compact for the\n\nPlacement of Children, juvenile justice and juvenile corrections\n\nofficials, and crime victims. All noncommissioner members of the\n\nInterstate Commission shall be ex officio (nonvoting) members. The\n\nInterstate Commission may provide in its bylaws for such additional\n\nex officio (nonvoting) members, including members of other national\n\norganizations, in such numbers as shall be determined by the\n\nInterstate Commission.\n\nD. Each compacting state represented at any meeting of the\n\nInterstate Commission is entitled to one vote. A majority of the\n\ncompacting states shall constitute a quorum for the transaction of\n\nbusiness, unless a larger quorum is required by the bylaws of the\n\nInterstate Commission.\n\nE. The Interstate Commission shall meet at least once each\n\ncalendar year. The chairperson may call additional meetings and,\n\nupon the request of a simple majority of the compacting states,\n\nshall call additional meetings. Public notice shall be given of all\n\nmeetings and meetings shall be open to the public.\n\nF. The Interstate Commission shall establish an executive\n\ncommittee, which shall include Interstate Commission officers,\n\nmembers, and others as determined by the bylaws. The executive\n\ncommittee shall have the power to act on behalf of the Interstate\n\nCommission during periods when the Interstate Commission is not in\n\nsession, with the exception of rulemaking and/or amendment to the\n\ncompact. The executive committee shall oversee the day-to-day\n\nactivities of the administration of the compact managed by an\n\nexecutive director and Interstate Commission staff; administers\n\nenforcement and compliance with the provisions of the compact, its\n\nbylaws and rules, and performs such other duties as directed by the\n\nInterstate Commission or set forth in the bylaws.\n\nG. Each member of the Interstate Commission shall have the\n\nright and power to cast a vote to which that compacting state is\n\nentitled and to participate in the business and affairs of the\n\nInterstate Commission. A member shall vote in person and shall not\n\ndelegate a vote to another compacting state. However, a\n\ncommissioner, in consultation with the state council, shall appoint\n\nanother authorized representative, in the absence of the\n\ncommissioner from that state, to cast a vote on behalf of the\n\ncompacting state at a specified meeting. The bylaws may provide for\non and shall not\n\ndelegate a vote to another compacting state. However, a\n\ncommissioner, in consultation with the state council, shall appoint\n\nanother authorized representative, in the absence of the\n\ncommissioner from that state, to cast a vote on behalf of the\n\ncompacting state at a specified meeting. The bylaws may provide for\n\nmembers’ participation in meetings by telephone or other means of\n\ntelecommunication or electronic communication.\n\nH. The Interstate Commission’s bylaws shall establish\n\nconditions and procedures under which the Interstate Commission\n\nshall make its information and official records available to the\n\npublic for inspection or copying. The Interstate Commission may\n\nexempt from disclosure any information or official records to the\n\nextent they would adversely affect personal privacy rights or\n\nproprietary interests.\n\nI. Public notice shall be given of all meetings and all\n\nmeetings shall be open to the public, except as set forth in the\n\nrules or as otherwise provided in the compact. The Interstate\n\nCommission and any of its committees may close a meeting to the\n\npublic where it determines by two-thirds vote that an open meeting\n\nwould be likely to:\n\n1. Relate solely to the Interstate Commission’s internal\n\npersonnel practices and procedures;\n\n2. Disclose matters specifically exempted from disclosure by\n\nstatute;\n\n3. Disclose trade secrets or commercial or financial\n\ninformation which is privileged or confidential;\n\n4. Involve accusing any person of a crime, or formally\n\ncensuring any person;\n\n5. Disclose information of a personal nature where disclosure\n\nwould constitute a clearly unwarranted invasion of personal privacy;\n\n6. Disclose investigative records compiled for law enforcement\n\npurposes;\n\n7. Disclose information contained in or related to examination,\n\noperating or condition reports prepared by, or on behalf of or for\n\nthe use of, the Interstate Commission with respect to a regulated\n\nperson or entity for the purpose of regulation or supervision of\n\nsuch person or entity;\n\n8. Disclose information, the premature disclosure of which\n\nwould significantly endanger the stability of a regulated person or\n\nentity; or\n\n9. Specifically relate to the Interstate Commission’s issuance\n\nof a subpoena, or its participation in a civil action or other legal\n\nproceeding.\n\nJ. For every meeting closed pursuant to this provision, the\n\nInterstate Commission’s legal counsel shall publicly certify that,\n\nin the legal counsel’s opinion, the meeting may be closed to the\n\npublic, and shall reference each relevant exemptive provision. The\n\nInterstate Commission shall keep minutes which shall fully and\n\nclearly describe all matters discussed in any meeting and shall\n\nprovide a full and accurate summary of any actions taken, and the\n\nreasons therefore, including a description of each of the views\n\nexpressed on any item and the record of any roll call vote\n\n(reflected in the vote of each member on the question). All\n\ndocuments considered in connection with any action shall be\n\nidentified in such minutes.\n\nK. The Interstate Commission shall collect standardized data\n\nconcerning the interstate movement of juveniles as directed through\n\nits rules which shall specify the data to be collected, the means of\n\ncollection and data exchange and reporting requirements.
