Any municipal officer or employee upon final conviction of,\n\nor pleading guilty or nolo contendere to, a felony for bribery,\n\ncorruption, forgery or perjury or any other crime related to the\n\nduties of his or her office or employment in a state or federal\n\ncourt of competent jurisdiction shall forfeit retirement benefits\n\nprovided by law. The forfeiture of retirement benefits shall not\n\noccur if any such officer or employee received a deferred sentence,\n\nbut retirement benefits shall not commence prior to completion of\n\nthe deferred sentence. The forfeiture of retirement benefits\n\nrequired by this section shall not include the officer's or\n\nemployee's contributions to the retirement system or retirement\n\nbenefits that are vested on the effective date of this act.\n\nB. The forfeiture of retirement benefits as provided by\n\nsubsection A of this section shall also apply to any such officer or\n\nemployee who, after leaving the office or employment, is convicted\n\nof, or pleads guilty or nolo contendere to, in a state or federal\n\ncourt of competent jurisdiction, a felony committed while in such\n\noffice or employment, where the felony is for bribery, corruption,\n\nforgery or perjury or any other crime related to the duties of his\n\nor her office or employment.\n\nC. The forfeiture shall continue until such time as the\n\nconviction or guilty plea is reversed by the highest appellate court\n\nto which the officer or employee may appeal.\n\nD. The attorney responsible for prosecuting the municipal\n\nofficer or employee shall notify the retirement system in which the\n\nofficer or employee is enrolled of the forfeiture of the officer's\n\nor employee's retirement benefits. Upon receipt of the notice of\n\nforfeiture, the retirement system shall immediately suspend all\n\nbenefits of the officer or employee, and shall notify the officer or\n\nemployee of his or her right to a hearing to review whether the\n\nconviction or plea qualifies for forfeiture of benefits under this\n\nsection. If the conviction or plea occurs in federal court or the\n\nnotice of forfeiture is not forthcoming from the state prosecutor,\n\nthe retirement system may investigate and gather court documents and\n\ncontact prosecutors to determine whether the conviction or plea\n\nqualifies under this section. Upon obtaining sufficient\n\ndocumentation of the conviction or plea, the retirement system shall\n\nimmediately suspend all benefits of the officer or employee, and\n\nnotify the officer or employee of his or her right to a hearing to\n\nreview whether the conviction or plea qualifies for forfeiture of\n\nbenefits under this section.\n\nE.
