Stat. tit. 11, § 11-12-103.1","heading":"Nomination and election of at large trustees -","body":"Ordinance - Petition.\n\nA. The board of trustees may, by ordinance, provide for the\n\nnomination and election at large of the trustees of a statutory town\n\nboard of trustees form of government; provided, however, that such\n\nordinance shall not become effective until sixty (60) days following\n\nthe date of its publication. After the ordinance becomes effective,\n\nthe requirement that trustees of a town be residents of and\n\nnominated from wards shall not apply.\n\nB. Within such sixty-day period, the registered voters of such\n\ntown may petition for an election on the question of nominating and\n\nelecting the trustees at large. The petition shall be signed by a\n\nnumber of such registered voters that is not less than twenty\n\npercent (20%) of the votes cast at the most recent election for the\n\ntown office receiving the greatest number of votes. The petition\n\nshall be filed with the town clerk. The ordinance providing for the\n\nnomination and election of trustees at large shall be suspended\n\npending the determination of the sufficiency of the number of\n\nsignatures on the petition or the determination of the results of\n\nthe election.\n\nC. Each petition filed with the town clerk shall be on a\n\nseparate sheet and shall be authenticated by the affidavit of at\n\nleast one credible witness that the signatures are genuine and that\n\nthe signers of the petition are registered voters of the town. The\n\nclerk shall make a physical count of the number of signatures\n\nappearing on the petitions and shall verify with the county election\n\nboard the number of votes cast at the most recent town election for\n\nthe office receiving the greatest number of votes. The clerk shall\n\nthen publish a notice of the filing and the apparent sufficiency or\n\ninsufficiency of the petition. The notice shall also state that any\n\nqualified elector of the town may file a protest to the petition or\n\nan objection to the count made by the clerk. A protest to the\n\npetition or the count of signatures shall be filed in the district\n\ncourt in the county in which the situs of the town is located within\n\nten (10) days after the publication. Written notice of the protest\n\nshall be served upon the clerk and the parties who filed the\n\npetition. In the case of the filing of an objection to the count,\n\nnotice shall also be served upon any party filing a protest. The\n\ndistrict court shall fix a day, not less than ten (10) days after\n\nthe filing of a protest, to hear testimony and arguments for and\n\nagainst the sufficiency of the petition. A protest filed by anyone,\n\nif abandoned by the party filing it, may be revived within five (5)\n\ndays by any other qualified elector. After the hearing, the\n\ndistrict court shall decide whether such petition is in form\n\nrequired by law. If the number of signatures on the petition is\n\ninsufficient, the ordinance shall become effective.\n\nD. If the number of signatures of the registered voters on the\n\npetition is sufficient, an election on the question shall be\n\nconducted as provided in the applicable sections of Article 16 of\n\nthis title. The question on the ballot shall read substantially as\n\nfollows:\n\nFor the nomination and election of\n\ntrustees at large ( )\n\nAgainst the nomination and election\n\nof trustees at large ( )\n\nE. If a majority of the votes cast on the question favor the\n\nnomination and election of trustees at large, the ordinance shall\n\nbecome effective.
