Stat. tit. 11, § 11-14-112","heading":"Cancellation or denial of driving privileges for","body":"noncompliance with municipal court sentence.\n\nA. As used in this section:\n\n1. \"Department\" means the Department of Public Safety;\n\n2. \"Notification form\" means a form prescribed by the\n\nDepartment which contains a statement from the court that the person\n\nhas failed to satisfy the sentence of the court. It shall include\n\nthe name, date of birth, physical description, and the driver\n\nlicense number, if any, of the person;\n\n3. \"Reinstatement form\" means a form prescribed by the\n\nDepartment which contains a statement from the court that the person\n\nhas satisfied the sentence of the court. It shall include\n\nsufficient information to identify the person to the Department;\n\n4. \"Sentence\" means any order of the court to pay a fine,\n\npenalty assessment or costs or to carry out a term of community\n\nservice or other remedial action.\n\nB. When any person under the age of eighteen (18) years fails\n\nor refuses to satisfy a sentence of a municipal court, the court\n\nshall notify the Department. Upon receipt of the notification form\n\nfrom the court, the Department shall cancel or deny all driving\n\nprivileges of the person without a hearing until the person\n\nsatisfies the sentence of the court.\n\nC. When the person fulfills the sentence of the court, the\n\ncourt or court clerk shall provide a reinstatement form to such\n\nperson either directly or by first class mail, postage prepaid, at\n\nthe last address given by the person to the court. The driving\n\nprivileges of a person who furnishes a reinstatement form to the\n\nDepartment shall be granted or reinstated, if the person is\n\notherwise eligible, in accordance with law. Upon such granting or\n\nreinstatement of driving privileges, the Department may remove any\n\nrecord of the denial or cancellation of driving privileges as\n\nprovided for in this section from the file of the person and\n\nmaintain an internal record of the denial or cancellation for fiscal\n\nor other purposes.\n\nD. At the time of sentencing the person, the court may take\n\ncustody of the driver's license of the person until the terms of the\n\nsentence are fulfilled. In such case, the court shall issue to the\n\nperson a receipt for the license.
