Stat. tit. 11, § 11-17-115","heading":"Reverse auction bidding – Procedure – Public disclosure","body":"- Remedies.\n\nA. A municipality or any public trust of which the municipality\n\nis beneficiary or any nonappropriated governmental agency or\n\ninstrumentality of the state is authorized to use a reverse auction\n\nbidding procedure to obtain bids for the purchase of goods or\n\nservices of any type of kind. The reverse auction shall be a real-\n\ntime bidding process taking place at a previously scheduled time and\n\nInternet location and for a previously established duration, in\n\nwhich multiple suppliers, anonymous to each other, submit bids to\n\nprovide the goods or services. The reverse auction procedure may be\n\nused as an alternative to any state law applicable to the purchase\n\nof the goods or services.\n\nB. The procedure shall provide:\n\n1. A bid opening and bid closure. At the opening date and\n\ntime, the municipality or public trust shall begin accepting reverse\n\nauction electronic bids. Reverse auction bids shall be accepted\n\nuntil the bid closure, except as provided by paragraph 6 of this\n\nsubsection, unless the municipality or public trust determines it is\n\nin the best interest of the municipality or public trust to extend\n\nthe closing time and notifies the reverse auction bidders of the\n\nextended closing time by public announcement at the Internet\n\nlocation at least fifteen (15) minutes prior to the original closing\n\ntime;\n\n2. The posting of all reverse auction bids electronically and\n\nupdating of bids on a real-time basis by the municipality or public\n\ntrust;\n\n3. The authorization for the municipality or public trust to\n\nrequire bidders to register before the opening date and time and, as\n\npart of that registration, require bidders to agree to any terms,\n\nconditions or other requirements of the solicitation or applicable\n\nacts;\n\n4. The authorization for the municipality or public trust to\n\nalso require potential bidders to prequalify as bidders and to\n\nrestrict solicitations to prequalified online and reverse auction\n\nbidders;\n\n5. The retention of the authority of the municipality or public\n\ntrust to determine the criteria that will be used as the basis for\n\nmaking awards; and\n\n6. The authorization for the municipality or public trust to\n\ndetermine it is in the best interest of the municipality or public\n\ntrust to allow it to accept an electronic bid after the specified\n\nofficial closing date and time, in the event the municipality or\n\npublic trust determines that a significant error or event occurred\n\nthat affected the electronic receipt of any reverse auction bid by\n\nthe municipality or public trust.\n\nC. All bids submitted electronically through the reverse\n\nauction bidding process pursuant to this section are subject to the\n\nsame public disclosure laws that govern bids received pursuant to\n\nany other law of this state governing procurement procedures for a\n\nmunicipality or public trust.\n\nD.
