This section shall be known and may be cited as the\n\n“Municipal Fiscal Impact Act”.\n\nB. As used in this section, “direct adverse fiscal impact”\n\nmeans the cost in dollars to a municipality in this state of a\n\nstatute which imposes a mandate for the new or additional\n\napplication of municipal resources or reduces existing municipal\n\nresources without providing revenue which would fully fund the\n\nmandate. Municipal resources may include, but are not limited to:\n\nlaw enforcement, fire protection, health and medical services, power\n\nand water services, streets, bridges or highways and recreational\n\nservices.\n\nC. A fiscal impact statement shall be required for any bill or\n\nresolution which is determined by the chair of the legislative\n\ncommittee to which the bill or resolution is assigned to have a\n\npotential direct adverse fiscal impact on municipalities in this\n\nstate. The impact statement shall identify the estimated amount of\n\nthe fiscal impact and any source of federal, state or local revenue\n\nthat will be used to fund the proposed mandate. If the chair of the\n\ncommittee to which the bill or resolution is assigned determines\n\nthat the bill or resolution, or a proposed amendment, is subject to\n\nthe provisions of this section, the chair shall:\n\n1. Request the preparation of a fiscal impact statement prior\n\nto placing the bill, resolution or amendment on the agenda to be\n\nconsidered at a meeting of the committee;\n\n2. Provide notice to the principal author of the bill,\n\nresolution or amendment regarding the determination; and\n\n3. Make the fiscal impact statement available, on and after the\n\ndate of the committee meeting during which the bill or resolution is\n\nconsidered, to the author, members of the committee considering the\n\nbill or resolution and any other party requesting information.\n\nD. No bill, resolution or amendment determined to have a direct\n\nadverse fiscal impact on municipalities in excess of One Hundred\n\nThousand Dollars ($100,000.00) statewide shall be reported out of\n\nthe committee to which it is assigned, or in the case of a floor\n\namendment, shall be acted upon by the relevant house, unless a\n\nfiscal impact statement of the bill is made.\n\nE. Any bill, resolution or amendment determined to have a\n\ndirect adverse fiscal impact on municipalities in excess of One\n\nHundred Thousand Dollars ($100,000.00) statewide for which an\n\nemergency clause has not received required approval pursuant to\n\nSection 58 of Article V of the Oklahoma Constitution shall not go\n\ninto effect until July 1 of the following calendar year.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2d5f6639b638cbb18944277e9eebf88afe8424008f0f199c56e8fcd075be28d2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-17-218","next":"us-ok/okla.-stat.-tit.-11-11-18-101"},"notice":"GroundRules: Original legal text.
