Except as otherwise provided by subsections B and C of this\n\nsection, no territory within five (5) miles of the corporate limits\n\nof a municipality having a population of more than two hundred\n\nthousand (200,000), and no territory within three (3) miles of the\n\ncorporate limits of any municipality having a population less than\n\ntwo hundred thousand (200,000), according to the latest federal\n\ncensus, shall be included in the survey and plat provided in Section\n\n2-103 of this title or incorporated as a new municipality.\n\nB. Territory within five (5) miles of the corporate limits of a\n\nmunicipality having a population of more than two hundred thousand\n\n(200,000) may incorporate as a new municipality if it can be proved\n\nto the board of county commissioners by documentation that the\n\nterritory has historically been identified as a community of people\n\nresiding in compact form. Such territory shall be included in the\n\nsurvey and plat provided in Section 2-103 of this title or\n\nincorporated as a new municipality.\n\nC. Territory within three (3) miles of the corporate limits of\n\na municipality having a population of less than two hundred thousand\n\n(200,000) may incorporate as a new municipality if it can be proved\n\nto the board of county commissioners by documentation that the\n\nterritory has historically been identified as a community of people\n\nresiding in compact form. Such territory shall be included in the\n\nsurvey and plat provided in Section 2-103 of this title or\n\nincorporated as a new municipality.\n\nD. Upon application of any person or municipality affected, the\n\ndistrict court in the county where such territory is located may\n\nafford appropriate relief for any violation of this section.
