Territory may be detached from the corporate limits of a\n\nmunicipality by the governing body when:\n\n1. An ordinance of the governing body so directs; or\n\n2. A petition requesting detachment, signed by at least three-\n\nfourths (3/4) of the registered voters and by the owners of at least\n\nthree-fourths (3/4), in value, of the property to be detached, is\n\nfiled with the governing body.\n\nOnly land which is within the limits of the municipality and\n\nupon its border and not laid out in lots and blocks, or land which\n\nhad been annexed to a municipality, may be detached by petition.\n\nB. Petitioners for detachment of municipal territory shall\n\ncomply with the following procedures:\n\n1. A true and complete unsigned copy of the petition requesting\n\ndetachment shall be filed with the clerk of the municipality before\n\nit is circulated and signed by at least three-fourths (3/4) of the\n\nregistered voters and by the owners of at least three-fourths (3/4),\n\nin value, of the property to be detached, as required by subsection\n\nA of this section;\n\n2. Signed copies of the petition requesting detachment shall be\n\nfiled with the clerk of the municipality within ninety (90) days\n\nafter the initial filing of the unsigned copy with the clerk; and\n\n3. Notice of the filing of the signed petition requesting\n\ndetachment with the clerk of the municipality shall be given in the\n\nsame manner provided for petitions requesting annexation.\n\nFailure to comply with the notice requirement or the other\n\nprocedures set forth in this subsection shall render the petition\n\nfor detachment insufficient and no action thereon shall be required\n\nby the clerk or governing body of the municipality.\n\nC. When signed copies of the petition requesting detachment are\n\ntimely filed with the clerk of the municipality, the clerk shall\n\ndetermine the sufficiency of the signatures appearing on the\n\npetition. The clerk shall then publish, in at least one newspaper\n\nof general circulation in the municipality, a notice of the filing\n\nand the apparent sufficiency or insufficiency of the petition.\n\nWithin ten (10) days following the publication, the governing body\n\nof the municipality shall hold a public hearing on the petition\n\nrequesting detachment and take such action thereon as the governing\n\nbody deems appropriate, which may include approval, denial, or\n\ndeferral.\n\nD. Appeal to the district court concerning any action by the\n\nclerk or governing body of the municipality on a petition requesting\n\ndetachment shall be in the same manner provided for petitions\n\nrequesting annexation.\n\nE. Territory to be detached under subsection A of this section\n\nshall not be detached if:\n\n1. The territory includes an intervening strip less than four\n\n(4) rods wide;\n\n2. The territory is separated from the corporate limits of a\n\nmunicipality only by a railway right-of-way;\n\n3. The territory is a highway right-of-way adjacent to or\n\ncontiguous with a municipality; or\n\n4. The territory includes properties that will be split in two,\n\nresulting in part of the property falling inside the corporate\n\nlimits of a municipality and part of it falling outside the\n\ncorporate limits of the municipality.\n\nF.
