Stat. tit. 11, § 11-21-222","heading":"Condemnation proceedings relating to rural electric","body":"cooperatives or electric public utilities - Moratorium -\n\nImplementation of retail consumer choice contingency.\n\nThere is hereby declared a moratorium on all municipal\n\ncondemnation proceedings instituted pursuant to Section 437.2 of\n\nTitle 18 of the Oklahoma Statutes, initiated prior to the enactment\n\nof electric restructuring enabling legislation and the\n\nimplementation of consumer choice of retail electric energy\n\nsuppliers. The moratorium shall also apply to all municipalities or\n\npublic trusts thereof which attempt to condemn the facilities of\n\nelectric public utilities or rural electric cooperatives for the\n\npurpose of utilizing such facilities for the delivery of electric\n\npower and energy. The moratorium shall remain in effect until the\n\nenactment of electric restructuring enabling legislation and\n\nimplementation of consumer choice of retail electric energy\n\nsuppliers. Upon such enactment of electric restructuring enabling\n\nlegislation and implementation of consumer choice of retail electric\n\nenergy suppliers, the municipal condemnation provisions authorizing\n\nmunicipalities with electric utilities to condemn the facilities of\n\nrural electric cooperatives contained in Section 437.2 of Title 18\n\nof the Oklahoma Statutes is hereby repealed.
