As used in this act:\n\n1. \"Adult novelty shop\" means a commercial establishment that\n\ndisplays, sells, or offers for sale instruments, devices, or\n\nparaphernalia designed or marketed primarily for use to stimulate\n\nhuman genital organs or for use in connection with sadomasochistic\n\npractices; and\n\n2. \"Sadomasochistic practices\" means flagellation or torture by\n\nor upon a person clothed or naked, or the condition of being\n\nfettered, bound, or otherwise physically restrained on the part of\n\none so clothed or naked.\n\nB. The location of an adult novelty shop shall be subject to\n\nthe nondiscriminatory zoning ordinances of the town or city in which\n\nlocated, and the location of such entities is specifically\n\nprohibited within one thousand (1,000) feet of:\n\n1. Any building primarily and regularly used for worship\n\nservices and religious activities;\n\n2. Any public or private school;\n\n3. Any public park or playground;\n\n4. Any public library; or\n\n5. Any land zoned or used for residential purposes.\n\nProvided, that if any such building used for worship and\n\nreligious activities, any public or private school, any public park\n\nor playground, any public library or any land zoned or used for\n\nresidential purposes shall be established within one thousand\n\n(1,000) feet of any such premises after the premises have been\n\nestablished, this shall not be a bar to the continuation of the\n\nbusiness so long as it has been in continuous force and effect. The\n\ndistance indicated in this subsection shall be measured from the\n\nnearest property line of such church or school to the nearest public\n\nentrance door of the premises of the adult novelty shop along the\n\nstreet right-of-way line providing the nearest direct route usually\n\ntraveled by pedestrians between such points.
