Stat. tit. 11, § 11-22-114","heading":"Entry upon private property for making surveys,","body":"soundings, examination or terminating public utility services -\n\nReimbursement for damages.\n\nA. Municipalities through their authorized agents or employees\n\nmay enter upon any lands, waters, or premises for the purpose of\n\nmaking surveys, soundings, or examinations as may be necessary for\n\nthe purpose of establishing, locating, relocating, constructing, or\n\nmaintaining any sewer, waterworks, drain, or public works or\n\nfacilities. Entry may also be made for the purpose of terminating\n\nany public utility services if the municipality determines the\n\nexistence of a hazard to the health, safety, or welfare of the\n\ngeneral public in connection with said services. Said entry shall\n\nnot be deemed a trespass, nor shall an entry pursuant to any\n\ncondemnation proceedings which may be pending be deemed a trespass.\n\nIf the municipality does not have written consent for entry from the\n\nowner and lessee, the municipality shall give notice to the owner\n\nand lessee of the property to be entered, by certified mail at least\n\nfourteen (14) days prior to any entry. If the owner and lessee are\n\nunable to be given notice by certified mail, notice shall be given\n\nby publication.\n\nB. Municipalities shall make reimbursement for any actual\n\ndamages to lands, water, or premises as a result of the entry onto\n\nproperty as authorized in this section. If there is a disagreement\n\nas to the amount of any damage, either the person incurring any\n\ndamage to land, water, or premises or the municipality may file a\n\npetition with the district court in the county where the alleged\n\ndamage occurred requesting the appointment of a commissioner to\n\nappraise the damage and proceed to have the damage determined as in\n\ncondemnation proceedings.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f8b527824cf61e9293a852a588b3238e2516a2cfb70603c77eee35aea495e426","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-22-113","next":"us-ok/okla.-stat.-tit.-11-11-22-115"},"notice":"GroundRules: Original legal text.
