No commercial pet breeder shall be located within two\n\nthousand five hundred (2,500) feet of a public or private school or\n\nlicensed day care facility in a municipality having a population of\n\nmore than three hundred thousand (300,000). Provided, this\n\nprohibition shall not apply to a commercial pet breeder that was\n\nlawfully in operation and in full compliance with all licensing,\n\npermitting, and zoning requirements applicable to the commercial pet\n\nbreeder prior to the effective date of this act.\n\nB. No public officer or employee shall issue any type of\n\nlicense, permit, approval or consent for a commercial pet breeder to\n\nbe located within two thousand five hundred (2,500) feet of a public\n\nor private school or licensed day care facility in a municipality\n\nhaving a population of more than three hundred thousand (300,000).\n\nC. Applications for a commercial pet breeder license or for any\n\ngovernmental permit, approval or consent needed to authorize the\n\nlawful operation of a commercial pet breeder that are pending on the\n\neffective date of this act shall be subject to the prohibitions set\n\nforth in subsections A and B of this section.\n\nD. The provisions of subsections A and B of this section may be\n\nenforced by any public officer within whose jurisdiction a\n\nnoncompliant commercial pet breeder is located or by any other\n\nperson aggrieved in any way by noncompliance with the provisions.\n\nEnforcement action may include a civil suit for an injunction filed\n\nin the district court in the county where a noncompliant commercial\n\npet breeder is located.\n\nE. Any municipality is hereby authorized to enact an ordinance\n\nconsistent with the provisions of this section and to enforce the\n\nordinance by prosecution of violations in the municipal court, as\n\nprovided by law.\n\nF.
