Except as provided by other provisions of Title 11 of the\n\nOklahoma Statutes governing disposition of certain specific types of\n\nintangible property, any intangible property held for the owner or\n\napparent owner by a municipality or a municipal public trust that\n\nremains unclaimed by the owner or apparent owner for one (1) year or\n\nmore after becoming payable or distributable is presumed abandoned\n\nand shall be disposed of as provided by subsection B of this\n\nsection.\n\nB. Intangible property presumed abandoned pursuant to the\n\nprovisions of subsection A of this section shall be disposed of by\n\nthe municipality or municipal public trust as follows:\n\n1. a. The municipality or municipal public trust shall mail\n\nwritten notice to the owner or apparent owner at his\n\nor her last-known address stating that the intangible\n\nproperty shall be paid over to the municipality or\n\nmunicipal public trust unless the owner or apparent\n\nowner files a claim therefor with the clerk of the\n\nmunicipality or with the secretary of the municipal\n\npublic trust, as applicable, within two (2) years of\n\nthe date of the notice.\n\nb. If the address of the owner or apparent owner is\n\nunknown, or the mailed notice required by subparagraph\n\na of this paragraph is returned as undeliverable, the\n\nmunicipality or municipal public trust shall publish\n\nsuch notice two (2) times in a newspaper of general\n\ncirculation within the county where the principal\n\noffices of the municipality or municipal public trust\n\nare located; and\n\n2. If the intangible property is not claimed by the owner or\n\napparent owner within two (2) years of the latest date of the mailed\n\nor published notice, as provided in paragraph 1 of this subsection,\n\nthen the claim of such owner or apparent owner shall be extinguished\n\nand the property shall be disposed of as may be determined and\n\ndirected by the municipal governing body or by the trustees of the\n\npublic trust, as applicable.\n\nC. As used in this section:\n\n1. “Apparent owner” means the person whose name appears on the\n\nrecords of the municipality or municipal public trust as the person\n\nentitled to intangible property held, issued, or owning by the\n\nmunicipality or municipal public trust;\n\n2. “Intangible property” means money, warrants, checks, drafts,\n\ndeposits, interest, dividends, income, credit balances, customer\n\noverpayments, security deposits, refunds, credit memos, unpaid\n\nwages, unused airline tickets, unidentified remittances and other\n\nsimilar personal property;\n\n3. “Last-known address” means a description of the location of\n\nthe owner or apparent owner sufficient for the purpose of the\n\ndelivery of mail;\n\n4. “Municipal public trust” means any public trust of which one\n\nor more municipalities are the sole beneficiary or beneficiaries;\n\nand\n\n5. “Owner” means a depositor in the case of a deposit, a\n\nbeneficiary in case of a trust other than a deposit in trust, a\n\ncreditor, claimant, or payee in the case of other intangible\n\nproperty, or a person having a legal or equitable interest in\n\nproperty subject to this act, or his or her legal representative.\n\nWhen used in this section, the term “owner” shall encompass both a\n\nsingle owner or multiple owners.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"66650e7c1de98415fb4655b93cffff2748f7fba0f22b8a230e778fdea220a458","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-22-135","next":"us-ok/okla.-stat.-tit.-11-11-22-137"},"notice":"GroundRules: Original legal text.
