Stat. tit. 11, § 11-22-140.1","heading":"Definitions","body":"As used in this act:\n\n1. \"Code enforcement director\" means an employee of a\n\nmunicipality who is tasked by the municipal governing body with the\n\nenforcement of state law or local ordinances related to the\n\ncondition of real property within the jurisdiction of the\n\nmunicipality;\n\n2. \"Interested party\" means:\n\na. the person who last appears as owner of the real\n\nproperty in the county records,\n\nb. the current mortgagee of record of the property or\n\nassignee of record of the mortgagee,\n\nc. the current holder of a beneficial interest in a deed\n\nof trust recorded against the real property,\n\nd. a tax certificate holder, or\n\ne. any party having an interest in the real property, or\n\nin any part thereof, legal or equitable, in severalty\n\nor as tenant in common, whose identity and address are\n\nreasonably ascertainable from the records of the\n\nmunicipality or records maintained in the county\n\nrecords or as revealed by a full title search,\n\nconsisting of fifty (50) years or more.\n\nAn interested party shall not include the holder of the benefit\n\nof an easement which burdens the real property, the holder of the\n\nbenefit or burden of a real covenant which burdens the real\n\nproperty, or the holder of the benefit of a utility easement which\n\nburdens the real property;\n\n3. \"Minimum bid price\" means the price that equals the\n\nredemption amount;\n\n4. \"Municipal code lien\" means any lien that has been levied\n\nagainst real property by a municipality that is the result of the\n\nnonpayment of any fine, penalty, abatement cost, or enforcement cost\n\nincurred by a municipality related to the enforcement of state or\n\nlocal housing and building codes. Such lien shall include only\n\nthose liens which arise out of a failure to comply with any law of\n\nthe State of Oklahoma, or from the failure to comply with a\n\nmunicipality's ordinances or resolutions.\n\nA municipal code lien shall not include any lien that has\n\npreviously been certified to the tax collector of the county for\n\ninclusion on the property tax bill associated with the real\n\nproperty;\n\n5. \"Municipal code lien payoff\" means the principal amount of a\n\nmunicipal code lien, interest accrued at the rate of seven and one-\n\nhalf percent (7.5%) per annum from the date the municipal code lien\n\nwas filed in the office of the county clerk, any fees or costs\n\nincurred in the collection of such a lien under this act including,\n\nwithout limitations, the cost of title examinations and publication\n\nof notices, and any other penalties allowable under either the laws\n\nof the State of Oklahoma or under an ordinance or resolution enacted\n\nby the municipality;\n\n6. \"Owner-occupied\" means real property that is lawfully\n\noccupied as a principal residence that is any of the following:\n\na. a homestead as described in Section 2888 of Title 68\n\nof the Oklahoma Statutes,\n\nb. exempt from ad valorem taxation under Sections 2904\n\nthrough 2911 of Title 68 of the Oklahoma Statutes, and\n\nc. eligible for the designations listed in subparagraph a\n\nor b or this paragraph, but which has not yet been\n\ngranted such designation and which is lawfully\n\noccupied by the family of a deceased individual;\n\n7. \"Redemption amount\" means the sum of:\n\na. the full amount of the municipal code lien payoff for\n\neach municipal code lien on which the municipality is\n\nseeking to foreclose under this act, and\n\nb. any tax payoff that may be applicable to the property\n\non which the municipality is seeking to foreclose\n\nunder this act;\n\n8. \"Taxes\" means those taxes assessed against real property by\n\neither the State of Oklahoma, the county in which the real property\n\nis situated, or the municipality that are delinquent as of the date\n\na proceeding under this act is commenced or at any time before final\n\nresolution of the same, and shall also include any taxes assessed\n\nagainst real property that are unpaid from any previous year and any\nes\" means those taxes assessed against real property by\n\neither the State of Oklahoma, the county in which the real property\n\nis situated, or the municipality that are delinquent as of the date\n\na proceeding under this act is commenced or at any time before final\n\nresolution of the same, and shall also include any taxes assessed\n\nagainst real property that are unpaid from any previous year and any\n\namounts required for redemption. As provided in Section 3103 of\n\nTitle 68 of the Oklahoma Statutes, a lien for taxes shall be\n\nsuperior to all other liens, including municipal code liens;\n\n9. \"Tax certificate holder\" means any of the following:\n\na. a tax sale purchaser who holds a certificate of\n\npurchase,\n\nb. the state, where it has accepted and recorded a\n\ncertificate of purchase obtained at a tax sale,\n\nc. any party to which a certificate of purchase obtained\n\nat a tax sale has been assigned, or\n\nd. the purchaser or assignee of a tax lien certificate;\n\nand\n\n10. \"Tax payoff\" means all amounts necessary to satisfy any\n\nclaims for delinquent taxes assessed against the real property on\n\nwhich the municipality is seeking foreclosure under this act. Those\n\namounts shall include:\n\na. if the taxes associated with the property are\n\ndelinquent, but the property has not yet been sold for\n\ntaxes, the full amount of delinquent taxes, costs,\n\nfees, and charges due to the county tax collector,\n\nb. if the property has been sold for taxes to either the\n\nstate or to a party other than the state, those\n\namounts required for redemption, except for when a\n\nmunicipality is the prevailing bidder, the tax payoff\n\namount shall be the lesser of these amounts, and\n\nc. if a tax lien has been sold by a county, the amount\n\nrequired for redemption.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2637b02e59355fde3155e0c9d1601bc86176178764b86e175e27015334f8f2d7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-22-140","next":"us-ok/okla.-stat.-tit.-11-11-22-140.2"},"notice":"GroundRules: Original legal text.
