Any municipality to which this act applies may proceed with\n\njudicial in rem foreclosures of municipal code liens in accordance\n\nwith the provisions of this act by enactment of an ordinance or\n\nresolution of the governing authority of the municipality in which\n\nthe real property is located, which ordinance or resolution shall be\n\nsufficient authority for use of this act by the municipality to\n\nenforce its municipal code liens.\n\nB. The ordinance or resolution of a municipality authorizing\n\nand approving the use of this act shall include all of the\n\nfollowing:\n\n1. The initial effective date for application of these\n\nprocedures;\n\n2. The explicit exclusion of owner-occupied properties from the\n\napplication of the judicial in rem foreclosure procedures authorized\n\nin this act;\n\n3. The nature and extent of notices, support services, and\n\nreferrals to be provided to the owners and occupants of owner-\n\noccupied properties; and\n\n4. Any other matters the municipality specifies to be addressed\n\nthrough administrative regulations and policies.\n\nC. Proceedings in accordance with this act are to solely\n\nenforce the municipal code lien for real property subject to the\n\nmunicipal code lien and shall not constitute an action for personal\n\nliability for the municipal code liens against the owner or owners\n\nof the real property.\n\nD. The rights and remedies set forth in this act are available\n\nsolely to the governmental entities authorized by law to enforce\n\nmunicipal ordinances and shall not extend to any nongovernmental\n\ntransferee of municipal code liens.\n\nE. A municipality that has adopted the provisions of this act\n\nand that seeks to enforce a municipal code lien through the sale of\n\nreal property shall utilize the judicial in rem proceedings of this\n\nact as the sole remedy for the enforcement through the sale of real\n\nproperty.\n\nF.
