Stat. tit. 11, § 11-32-116","heading":"Easements on streets and alleys for parking stations -","body":"Lease of parking stations by municipality.\n\nA. For the purposes of this article, the right of public use\n\nand of the enjoyment of the streets and alleys within any\n\nmunicipality, heretofore or hereafter dedicated or otherwise\n\nestablished, is hereby declared to constitute an easement on the\n\nland upon which the streets and alleys are located. Such easement\n\nis hereby vested in the State of Oklahoma with all incidents of\n\nownership thereof, except as provided in subsection B of this\n\nsection; provided, that the management of such easements located\n\nwithin any municipality is hereby delegated to the municipality\n\nexcept insofar as the management of the easements has been, or\n\nhereafter shall be expressly restricted by law. The proprietary\n\nright in the easements and the management thereof shall not operate\n\nto alter, impair or divest in any manner whatsoever the state or any\n\nof its political subdivisions to the extent of any delegation by the\n\nstate of the governmental control and regulation of the use and\n\nenjoyment of streets and alleys as thoroughfares.\n\nB. All improvements made to any street or alley and all\n\nmaintenance and repair thereof shall be effected solely pursuant to\n\nthe governmental control and regulation of the streets and alleys as\n\nthoroughfares; and the ownership and management of the easements\n\ndescribed herein as such shall not include the right of improvement\n\nor maintenance of the easements.\n\nC. For the purpose of expediting traffic and the use and\n\nenjoyment by the public of the easements described herein for\n\nthroughfares, each municipality to which management thereof is\n\ndelegated may prohibit parking or may designate specific portions of\n\nthe easements for limited use for vehicle parking; may prescribe the\n\nlimitations of such use for specified periods of time; may fix and\n\ncollect a fee or charge for such limited and special use by vehicle\n\noperators, which fee or charge may be required to be paid in advance\n\nfor each specified period of time; may lease designated portions of\n\nthe easements for the operation of limited vehicle parking thereon\n\nupon the condition that the lessee under any such lease shall make\n\nno greater charges for vehicle parking on the leased portion or\n\ndifferent periods of parking use than shall be specified in the\n\nlease. Each municipality, by ordinance, may protect any self-\n\noperated or leased parking stations or any portions of the easements\n\ndesignated for prohibited or limited vehicular parking from\n\nunauthorized trespass, may penalize violations, and authorize the\n\nremoval and impoundment and sale for costs of removal and penalties\n\nof any trespassing vehicle. All revenues derived from fees and\n\ncharges by any municipality and all lease rentals from the leasing\n\nof the easements shall be received by the municipality as\n\ncompensation for its management of the easements.\n\nD. Any lease made pursuant to this article shall constitute an\n\nenforceable contract between the respective municipality and its\n\nlessee, and shall not be impaired by any action of the municipality\n\nduring its effective term.
