The governing body of any municipality owning a lake, inside\n\nor outside of the corporate limits, or owning lands, inside or\n\noutside of the corporate limits, which adjoin and abut upon a lake\n\nor large body of water capable of being used by a motor-propelled\n\nboat may own, construct, maintain, operate, and equip a marina,\n\ndocks, and boathouses for amusement, parks, and recreational\n\npurposes. The governing body may also lease or rent to any person\n\nlots or spaces and provide permits for the construction or use of\n\nprivately owned marinas, boathouses, or docks or other recreational\n\npurposes on such property for amusement, parks, and recreational\n\npurposes pursuant to such terms as the governing body deems proper.\n\nThe governing body may fix and collect fares, rents, tolls, or other\n\nrevenues for the use of such facilities, lots and spaces, and the\n\nissuance of permits. The right of a municipality to own, construct,\n\nmaintain, operate and equip docks, boathouses, and marinas, and to\n\nrent or lease such facilities, spaces, and lots and the issuance of\n\npermits for the construction or use of such privately owned marinas,\n\ndocks, or boathouses for amusement, parks, and recreational purposes\n\nis hereby declared to be a public right and use. Rent and lease of\n\nsuch facilities, lots, and spaces shall be at fair market value.\n\nExcept in cases of rentals and leases authorized herein, such right\n\nand facilities shall constitute a public benefit. The municipal\n\ngoverning body may do all things necessary and proper in its\n\ndiscretion pursuant to the authority granted to it by the\n\nConstitution and laws of this state to further the ability of the\n\nmunicipality to provide for the amusement, parks, and recreational\n\nservices authorized by the provisions of this section.\n\nB. Lakes and lands which adjoin and abut upon a lake owned or\n\nleased by a municipality or by a public trust of which a\n\nmunicipality is a beneficiary, which are dedicated for a public\n\npurpose, may also be used or leased, for fair market value, for\n\namusement, parks, or recreation without abandoning or declaring such\n\npublic property as surplus or unsuitable, provided the governing\n\nbody of the municipality determines use of such property for\n\namusement, parks, or recreation is a compatible contemporaneous use\n\nthat is subordinate to the primary public purpose for which the lake\n\nor land was purchased or leased.\n\nC. A municipality or public trust may contract with any person,\n\nentity, or any county, state, or federal agency to manage and\n\noperate lakes and lands which adjoin and abut upon a lake dedicated\n\nfor a public purpose or for amusement, parks, or recreation\n\ncontemporaneous with a public purpose as described in this section.\n\nD.
