Stat. tit. 11, § 11-35-201","heading":"Sale or lease of municipally owned public utility -","body":"Applicability - Charters.\n\nThe provisions of this section through Section 35-205 of this\n\ntitle relating to the procedure for selling or leasing municipally\n\nowned public utilities shall apply when the municipally owned public\n\nutility is to be sold or leased in its entirety and its fair market\n\nvalue exceeds Ten Thousand Dollars ($10,000.00). The provisions of\n\nthis section through Section 35-205 of this title shall not apply to\n\nany sale of property of a municipality to the state or any agency or\n\ncounty thereof or any sale or lease to a public trust of which the\n\nmunicipality is the sole beneficiary. Any municipality governed by\n\ncharter, when authorized by said charter, may sell, convey, or lease\n\nany public utility owned by the municipality without conducting an\n\nelection as provided for in Section 35-203 of this title.
