Stat. tit. 11, § 11-36-108","heading":"Encroachments not exceeding twenty-four inches -","body":"Quitclaim deed.\n\nA municipal governing body, in its discretion, may execute and\n\ndeliver to the owners of a building, business or religious\n\ninstitution a quitclaim deed to that part of the municipality's\n\nstreets or alleys which have been inadvertently encroached by such\n\nbuilding or institution under the following conditions: 1. The\n\ngoverning body finds that a residential building, business, or\n\nreligious institution located in the municipality has inadvertently\n\nencroached not to exceed twenty-four (24) inches on a street or\n\nalley of the municipality by constructing a part of a building\n\nthereon, which encroachment is of such limited character as not to\n\ninterfere with traffic on the street, alley, or on any sidewalk\n\nlocated thereon; 2. All the building facing the street are in\n\nsubstantial line with each other; 3. The encroachment has\n\nexisted continuously for more than fifteen (15) years last past; 4.\n\nIn the opinion of the governing body the encroachment does not\n\ninterfere with traffic on the street, alley, or sidewalk; and 5.\n\nPayment is made to the municipality of an amount which the governing\n\nbody finds to be a reasonable cash value of the property so\n\nconveyed.
