The Department of Transportation may, or the board of county\n\ncommissioners of any county or federally recognized tribal\n\ngovernment shall, by agreement with the governing body of a\n\nmunicipality having a population less than five thousand (5,000)\n\npersons, construct, improve, repair or maintain any of the streets\n\nof the municipality.\n\nB. The board of county commissioners may construct, improve,\n\nrepair, or maintain any of the streets of a municipality having a\n\npopulation of less than five thousand (5,000) persons subject to\n\nagreement between the governing bodies of the county and the\n\nmunicipality without regard to whether the municipality has passed a\n\nsales tax with proceeds earmarked to construct, improve, repair or\n\nmaintain any of the streets or roadways of such municipality.\n\nC. The board of county commissioners may construct, improve,\n\nrepair or maintain any of the streets of a municipality having a\n\npopulation of greater than five thousand (5,000) persons but less\n\nthan fifteen thousand (15,000) persons if the municipality has\n\npassed a sales tax or fee with the proceeds earmarked to construct,\n\nimprove, repair or maintain any of the streets or roadways of such\n\nmunicipality; provided, that the county has a population of less\n\nthan one hundred fifty thousand (150,000) persons.\n\nD. Notwithstanding any provision of this section, the board of\n\ncounty commissioners may construct, improve, repair, or maintain any\n\nof the streets of a municipality if the county has a population in\n\nexcess of one hundred fifty thousand (150,000) persons according to\n\nthe most recent Federal Decennial Census.
