If the owners of the railway shall fail or refuse to comply\n\nwith the order of the municipality to make such improvements by\n\npaving, chatting, graveling, macadamizing, or building sidewalks as\n\nthe municipality may direct, or to repair such paving, graveling,\n\nmacadamizing or sidewalks, such work may be done by the\n\nmunicipality. The cost and expense of such work done by the\n\nmunicipality may be charged against the railway company and may be\n\ncollected in the district court in the county in which the\n\nimprovements have been made, by action of law, in the name of the\n\nmunicipality against the railway company. In any such action at law\n\nit shall be sufficient to declare generally for work or labor done,\n\nor material furnished on the particular street, avenue, alley or\n\nhighway so improved.\n\nB. In addition to the remedy provided in this section for\n\ncollection of costs and expenses, the municipality, or any one\n\nauthorized by it to do the work, shall be entitled to a lien upon\n\nthe property of the railway company. Such lien shall exist for the\n\nfull amount of the cost and expense against the property of the\n\nrailway company adjacent or contiguous to the improvement or\n\nimprovements so made. The lien may be enforced against the property\n\nof the railway company by action in the district court in the county\n\nin which the improvements have been made.
