Stat. tit. 11, § 11-36-206","heading":"Protests - Determination of sufficiency - Effect of","body":"protests on the improvement.\n\nA. Protests which have been filed in accordance with Section\n\n36-204 of this title shall be heard and considered at the hearing on\n\nthe proposed improvement. The hearing may be continued from time to\n\ntime so that all protestants may be heard.\n\nB. The findings of the governing body as to the sufficiency or\n\ninsufficiency of any protest shall be conclusive and binding for all\n\npurposes and against all persons. At any hearing on such protests,\n\nthe governing body may compel the attendance of witnesses under oath\n\nto determine the sufficiency thereof, and no action or suit to\n\nquestion the findings of the governing body on the sufficiency of\n\nthe protests shall be commenced later than fifteen (15) days after\n\nthe finding.\n\nC. Any number of streets, avenues, lanes, alleys or other\n\npublic places, or parts thereof, to be improved may be included in\n\nthe resolution of necessity; but protests or objections shall be\n\nmade and considered separately as to each street or way. For the\n\npurpose of protest, disconnected parts of the same street shall be\n\ntreated as separate streets.\n\nD. If any street, avenue, lane, alley, or other public place,\n\nor part thereof, has been protested by the owners of more than fifty\n\npercent (50%) of the land liable to assessment for the improvement,\n\nthe municipal governing body shall not include the same in\n\nproceedings hereunder for a period of six (6) months except upon\n\npetition by the owners as provided in Section 36-202 of this title.\n\nE. If sufficient protests are filed as to any one or more of\n\nsuch streets, avenues, lanes, alleys or public places, or parts\n\nthereof, the same shall be eliminated from the proceedings, but the\n\nother streets, avenues, lanes, alleys or other public places, or\n\nparts thereof, as to which sufficient protests have not been filed\n\nshall not be affected thereby.\n\nF. Notwithstanding any of the provisions of this section, when\n\na section of any street or avenue included in the resolution of\n\nnecessity does not exceed two (2) blocks, and does not exceed one\n\nthousand (1,000) feet in length and at the ends or limits of the\n\nsection to be improved there is paving already constructed on and\n\nalong the street or avenue to be improved, the governing body may\n\ncause such improvement to be constructed and to charge the cost\n\nthereof to the property liable for assessment as herein provided\n\nregardless of the number of protests that are filed against the\n\nproposed improvement of such section, street or avenue.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5d088185a4f322728b0880aae6456e1e76888716d938c362eb402e7233511428","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-36-205","next":"us-ok/okla.-stat.-tit.-11-11-36-207"},"notice":"GroundRules: Original legal text.
