Stat. tit. 11, § 11-36-305","heading":"Consent to use bonds as payment for assessments","body":"The registered holder of any outstanding bonds issued to pay for\n\na street improvement may file his consent in writing with the\n\nmunicipal clerk to use the bonds to pay for an assessment, or\n\ninstallment thereof, which has been levied by the governing body.\n\nThe written consent shall be binding upon any transferee or assignee\n\nof the bonds, and upon all of the registered owners signing the\n\nconsent, as to all payments and discharges made for such assessment\n\nuntil written notice be filed with the clerk by the registered\n\nholder, transferee or assignee, of the bond terminating his consent\n\nthereto. After the written consent is filed and until written\n\nnotice of termination is given, the owner of any property in the\n\nstreet improvement district may present, with the written consent of\n\nthe registered holder or holders, to the clerk the bonds bearing the\n\nlowest serial numbers of the bonds outstanding in the series as\n\npayment for the assessment, or any installment thereof, upon the\n\nowner's property, whether delinquent or unmatured, with all interest\n\nand penalty thereon. The clerk shall endorse upon each bond the\n\namount of the installment, and interest and penalty thereon, for\n\nwhich the bond is tendered as payment. The clerk shall then issue a\n\nreceipt to the owner of the property for the amount of the\n\ninstallment, together with interest and penalty, for which credit\n\nhas been endorsed upon the bonds.
