Stat. tit. 11, § 11-36-312","heading":"Limitation of actions to enforce lien of bonds by","body":"holder not receiving refunding bonds.\n\nThe right of any bondholder, who has filed with the municipal\n\nclerk an \"Agreement to Accept Street Improvement Refunding Bonds\"\n\nbut who has not been issued street improvement refunding bonds, to\n\nenforce the lien of any street improvement bond or street\n\nimprovement refunding bond by foreclosure, mandamus, tax sale and\n\nresale, refunding, or otherwise, shall be barred upon the expiration\n\nof three (3) years after the date of the filing of his \"Agreement to\n\nAccept Street Improvement Refunding Bonds\". The running of the\n\nthree-year period of limitation shall be an absolute bar to any\n\naction or proceeding brought thereafter, whether the same be plead\n\nas a defense or not, and the property against which the bonds\n\nrepresented a lien shall thereafter be absolved of any lien or\n\nliability on account of the bonds or \"Agreement to Accept Street\n\nImprovement Refunding Bonds\". A certificate issued by the municipal\n\nclerk certifying that no holder of any such bonds has either\n\n1. filed his \"Agreement to Accept Street Improvement Refunding\n\nBonds\";\n\n2. commenced foreclosure, mandamus, refunding or otherwise,\n\nwithin the three-year period as prescribed herein; or\n\n3. commenced foreclosure within the three-year period\n\nprescribed in Section 36-310 of this title,\n\nshall operate to remove any cloud upon the title of any property\n\ncreated by the street improvement bond, the street improvement\n\nrefunding bond, or \"Agreement to Accept Street Improvement Refunding\n\nBonds\", and the liens represented thereby.
