Stat. tit. 11, § 11-36-410","heading":"Laying out or widening across public property -","body":"Declaration of necessity - Exceptions.\n\nWhenever the municipal governing body deems it necessary for\n\npublic use and convenience to extend, open, widen, or lay out any\n\nstreet or avenue over, upon or across any public property which is\n\nwholly within the municipal limits and which is owned by the state,\n\ncounty, school district, or board of education, the governing body\n\nby ordinance shall declare the public necessity for the use of such\n\nstreet.
