The provisions of this section shall apply to activities of\n\nthe wireless provider within the right-of-way.\n\nB. A person owning, managing or controlling authority poles in\n\nthe right-of-way may not enter into an exclusive arrangement with\n\nany person for the right to attach to such poles. A person who\n\npurchases or otherwise acquires an authority pole is subject to the\n\nrequirements of this section.\n\nC. An authority shall allow the collocation of small wireless\n\nfacilities on authority poles subject to the application process in\n\nSection 4 of this act and the make-ready process in this section.\n\nThe rates, fees and terms for such collocations shall be\n\nnondiscriminatory regardless of the services provided by the\n\ncollocating person, comply with this act and be made available to\n\nwireless providers under Section 10 of this act.\n\nD. The rates, fees and terms and conditions for the make-ready\n\nwork to collocate on an authority pole described in the application\n\nshall be nondiscriminatory, competitively neutral and commercially\n\nreasonable and must comply with this act. The authority may perform\n\nthe make-ready work necessary to enable the pole to support the\n\nrequested collocation by a wireless provider or require the wireless\n\nprovider to perform the make-ready work. If the authority elects to\n\nperform the make-ready work, it shall provide a good-faith estimate\n\nfor the work, including pole replacement if necessary, within sixty\n\n(60) days after receipt of a complete application. The authority\n\nshall complete any make-ready work it elects to perform, including\n\nany pole replacement, within sixty (60) days of written acceptance\n\nof the good-faith estimate by the applicant. An authority may\n\nrequire replacement of the authority pole only if it demonstrates\n\nthat the collocation would make the authority pole structurally\n\nunsound. The authority may require that the replaced authority pole\n\nhave the same functionality as the pole being replaced. If the\n\nauthority pole is replaced, the authority shall take ownership of\n\nthe new pole and operate authority fixtures on the pole.\n\nThe person owning, managing or controlling the authority pole\n\nshall not require more make-ready work than required to meet\n\napplicable codes or industry standards. Fees for make-ready work\n\nshall not include costs related to preexisting or prior damage or\n\nnoncompliance. Fees for make-ready work including any pole\n\nreplacement shall be reasonable and nondiscriminatory and shall not\n\nexceed actual costs, which may include the amount the authority pays\n\na professional engineer registered in Oklahoma to review the\n\nwireless provider's make-ready work plans.\n\nE. A wireless provider shall comply with the following\n\nrequirements and specifications:\n\n1. Requirements and specifications of the National Electrical\n\nSafety Code, the National Electrical Code and the Occupational\n\nSafety and Health Act, including amendments or revisions to such\n\nrequirements or specifications, and in the event of conflict, the\n\nmost stringent of such requirements and specifications;\n\n2. Requirements and specifications of general application\n\nadopted by the authority that do not conflict with this act,\n\nincluding requirements and specifications that concern how equipment\n\nshall be attached to electric distribution poles so they may be\n\nclimbed safely; and\n\n3.
