Stat. tit. 11, § 11-36-506","heading":"Authority's rates and fees for placement of a wireless","body":"facility, support structure or utility pole.\n\nA. This section shall govern an authority's rates and fees for\n\nthe placement of a wireless facility, wireless support structure or\n\nutility pole.\n\nB. An authority may not require a wireless provider to pay any\n\nrates, fees or compensation to the authority or other person other\n\nthan what is expressly authorized by this act for the right to use\n\nor occupy a right-of-way, for collocation of small wireless\n\nfacilities on utility poles in the right-of-way or for the\n\ninstallation, maintenance, modification, operation and replacement\n\nof utility poles in the right-of-way.\n\nC. Application fees shall be subject to the following\n\nrequirements:\n\n1. An authority may charge an application fee only if such fee\n\nis required for similar types of commercial development or\n\nconstruction within the authority's jurisdiction;\n\n2. An application fee may not include:\n\na. travel expenses incurred by a third party in its\n\nreview of an application, or\n\nb. direct payment or reimbursement of third-party rates\n\nor fees charged on a contingency basis or a result-\n\nbased arrangement;\n\n3. An application fee for a collocation shall be limited to the\n\ncost of granting a permit for similar types of commercial\n\ndevelopment or construction within the authority's jurisdiction.\n\nThe application and permit fees for collocation of small wireless\n\nfacilities on an existing or replacement authority pole shall not\n\nexceed Two Hundred Dollars ($200.00) each for the first five small\n\nwireless facilities on the same application and One Hundred Dollars\n\n($100.00) for each additional small wireless facility on the same\n\napplication; and\n\n4. The application and permit fees for the installation,\n\nmodification or replacement of a utility pole and the collocation of\n\nan associated small wireless facility that are permitted uses in\n\naccordance with the specifications in subsection D of Section 3 of\n\nthis act shall not exceed Three Hundred Fifty Dollars ($350.00) per\n\npole for access to the right-of-way.\n\nD. The rate for occupancy of the right-of-way shall not exceed\n\nTwenty Dollars ($20.00) per year per small wireless facility.\n\nE. The rates to collocate on authority poles in the right-of-\n\nway shall not exceed Twenty Dollars ($20.00) per authority pole per\n\nyear.\n\nF. There shall be no rate charged for the installation,\n\nplacement, maintenance, operation or replacement of micro wireless\n\nfacilities that are strung on cables between existing utility poles,\n\nin compliance with the National Electrical Safety Code.\n\nG. Rates provided in this section do not include any applicable\n\ncharges for electric power. A wireless provider must pay separately\n\nfor such services.\n\nH.
