An authority may adopt indemnification, insurance and\n\nbonding requirements related to small wireless facility permits\n\nsubject to the requirements of this section.\n\nB. An authority may require a wireless provider to defend,\n\nindemnify and hold harmless the authority and its officers, agents\n\nand employees against any claims, demands, damages, lawsuits,\n\njudgments, costs, liens, losses, expenses and attorney fees\n\nresulting from the installation, construction, repair, replacement,\n\noperation or maintenance of wireless facilities, wireless support\n\nstructures or utility poles to the extent caused by the wireless\n\nprovider, its contractors, subcontractors and their officers,\n\nemployees or agents. A wireless provider has no obligation to\n\ndefend, indemnify or hold harmless an authority, its officers,\n\nagents or employees against any liabilities or losses due to or\n\ncaused by the sole negligence of the authority or its employees or\n\nagents.\n\nC. An authority may require a wireless provider to have in\n\neffect insurance coverage naming the authority and its officers,\n\nagents and employees as additional insureds against the claims,\n\ndemands, damages, lawsuits, judgments, costs, liens, losses,\n\nexpenses and attorney fees described in subsection B of this\n\nsection, so long as the authority imposes similar requirements on\n\nother right-of-way users and such requirements are reasonable and\n\nnondiscriminatory.\n\nD. An authority may require a wireless provider to furnish\n\nproof of insurance, if required, prior to the effective date of any\n\npermit issued for a small wireless facility.\n\nE. An authority may adopt bonding requirements for small\n\nwireless facilities if the authority imposes similar requirements in\n\nconnection with permits issued for other right-of-way users.\n\n1. The purpose of such bonds shall be to:\n\na. provide for the removal of abandoned or improperly\n\nmaintained small wireless facilities, including those\n\nthat an authority determines need to be removed to\n\nprotect public health, safety or welfare,\n\nb. restoration of the right-of-way in connection with\n\nremovals under this paragraph, or\n\nc. recoup rates or fees that have not been paid by a\n\nwireless provider in over twelve (12) months, so long\n\nas the wireless provider has received reasonable\n\nnotice from the authority of any of the noncompliance\n\nlisted above and an opportunity to cure.\n\n2. An authority shall not require either of the following under\n\nparagraph 1 of this subsection:\n\na. a cash bond, unless any of the following apply:\n\n(1) the wireless provider has failed to obtain or\n\nmaintain a bond required under this section, or\n\n(2) the surety has defaulted or failed to perform on\n\na bond given to the authority on behalf of the\n\nwireless provider, or\n\nb. a bond in an amount exceeding One Thousand Dollars\n\n($1,000.00) per small wireless facility.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"55f983576f2c5eace51299a9cdb5da97916142d82c11b6610142da4079851b22","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-36-511","next":"us-ok/okla.-stat.-tit.-11-11-37-101"},"notice":"GroundRules: Original legal text.
