Stat. tit. 11, § 11-37-105","heading":"Condemnation procedure for acquiring land for","body":"waterworks.\n\nA municipality is vested with the power of eminent domain for\n\nthe purpose of acquiring lands for the location and building or\n\nenlargement of waterworks. The proceedings for the condemnation\n\nthereof, including the notices, appointment of commissioners,\n\nassessment of damages, possession, payment of compensation and\n\nappeals, shall be the same as is provided by law for the\n\ncondemnation of lands for railroad purposes. It shall not be\n\nnecessary in such condemnation proceedings to allege or prove any\n\nnegotiations for the purchase of any lands or interests therein\n\nwith:\n\n1. The owner or owners or claimants of any property sought to\n\nbe condemned, where such ownership does not appear clearly from the\n\ntitle records in the office of the county clerk of the county where\n\nthe lots or lands are situated; or\n\n2. The heirs of the person or persons who appear from such\n\nrecords to be the owner or owners, or persons who hold or claim\n\nunder such heirs, and the lands have not been partitioned at the\n\ntime the petition to condemn is filed.\n\nThe notice of application for appointment of commissioners to assess\n\ndamages in condemnation proceedings may be given by publication as\n\nprovided by law regulating the condemnation of lands for railroad\n\npurposes for notice to nonresidents.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"41204b60ff0055ca0d9b6af9e176fc0f75fc83a5f564ffac5b78a2faef9f3054","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-37-104","next":"us-ok/okla.-stat.-tit.-11-11-37-106"},"notice":"GroundRules: Original legal text.
