Stat. tit. 11, § 11-37-128","heading":"Public water trusts – Supervision by municipalities –","body":"Penalties - Exceptions.\n\nA. Any public water trust formed pursuant to Sections 176\n\nthrough 180.4 of Title 60 of the Oklahoma Statutes whose beneficiary\n\nis the state, any county or municipality or any combination thereof,\n\nsupplying water directly to residents of a municipality, shall be\n\nsubject to general supervision by such municipality with regards to\n\nany waterworks within the city limits of the municipality.\n\nB. 1. The municipality shall have power to promulgate\n\nregulations and enact ordinances affecting the services, operation,\n\nmanagement, rates and manner of conduct of the business of any\n\npublic water trust having waterworks within the city limits of the\n\nmunicipality.\n\n2. The municipality shall have full visitorial and\n\ninquisitorial power to examine the records of such public water\n\ntrust and keep informed as to the general condition, rates, plants,\n\nequipment, apparatus, conduct, operation, practices and services,\n\nand compliance with regulations and ordinances and laws of this\n\nstate with respect to the waterworks within the city limits of the\n\nmunicipality and with respect to any other management or conduct of\n\nthe public water trust which affects any of the waterworks within\n\nthe city limits of the municipality.\n\nC. It shall be unlawful for any public water trust to operate\n\nany waterworks within the city limits of a municipality in violation\n\nof the regulations promulgated or ordinances enacted by the\n\nmunicipality pursuant to this section.\n\nD. 1. Any person who violates any of the provisions of any\n\nregulation promulgated or ordinance enacted issued pursuant to this\n\nsection, upon conviction thereof, shall be guilty of a misdemeanor.\n\nEach day upon which such violation occurs shall constitute a\n\nseparate violation.\n\n2. In addition to any criminal penalty imposed pursuant to this\n\nsubsection, a public water trust which has been determined by the\n\nmunicipality to have violated any regulation or ordinance issued\n\npursuant to this section may be liable for a civil penalty of not\n\nmore than Five Hundred Dollars ($500.00) for each day that such\n\nviolation continues. The amount of such penalty shall be assessed\n\nby the municipality, after notice and hearing.\n\nE. 1. The district attorney of the appropriate district court\n\nof Oklahoma may bring an action in a court of competent jurisdiction\n\nfor the prosecution of such violation of any regulation or order\n\nissued pursuant to this section.\n\n2. The court has jurisdiction to determine such action and to\n\ngrant the necessary or appropriate relief, including, but not\n\nlimited to, mandatory or prohibitive injunctive relief, interim\n\nequitable relief, and punitive damages.\n\nF. The provisions of this section shall not apply to:\n\n1. Any public trusts formed as rural water districts and\n\nestablished pursuant to the Rural Water, Sewer, Gas and Solid Waste\n\nManagement District Act;\n\n2. Any municipality in a county having a population less than\n\nTwo Hundred Fifty Thousand (250,000) persons; or\n\n3. Waterworks or water systems owned or operated by a\n\nmunicipality or by any public trust of which a municipality is the\n\nsole beneficiary.\n\nG.
