Stat. tit. 11, § 11-37-205","heading":"Payment of construction and maintenance of public","body":"sewers and water lines - Petition.\n\nExcept as otherwise provided, the construction and maintenance\n\nof public sanitary sewers, storm sewers, and public waterlines shall\n\nbe paid for as follows:\n\n1. Unless otherwise provided for in this section, all mains and\n\nsubmains constructed by a municipality shall be paid for by the\n\nmunicipality. If a petition signed by the owners of more than one-\n\nhalf (1/2) of the area of the land that will be drained or benefited\n\nby the construction of such mains or submains is filed with the\n\ngoverning body or the governing body finds that certain property\n\nwill be specially benefited thereby, the governing body may create a\n\ndistrict and order the construction of such mains and submains and\n\nprovide for the payment therefor to be made by the owners of the\n\nproperty included within the district in accordance with the\n\nprocedure for the construction of and payment for district sewers\n\nand district waterlines. The petition shall be filed with the city\n\nclerk. The petition shall state in bold, capitalized letters at the\n\ntop of the page that the cost of the proposed improvements shall be\n\nassessed against the property benefited by the improvements;\n\n2. Laterals shall be paid for by the owners of the property\n\nabutting on such laterals in the manner provided for by law for the\n\nestimate of cost and assessments for district sewers and district\n\nwaterlines;\n\n3. If a main or submain is constructed in any alley or other\n\nplace where a lateral would otherwise have been constructed and the\n\nmain or submain serves the purpose of a lateral for the property\n\nabutting thereon, the owners of the property shall be assessed in\n\namounts equal to that which they would have been required to pay for\n\na sufficient lateral; and\n\n4. If any private connection is made with a main or submain\n\ninstead of with a lateral, the owner of the premises so connected\n\nshall pay to the municipality an amount equal to that which he would\n\nhave been required to pay for a lateral so constructed as to provide\n\nsimilar service.
