Stat. tit. 11, § 11-37-502","heading":"Allocation of funds – Application for funds -","body":"Eligibility.\n\nA. The monies in the Municipal Road Drilling Activity Revolving\n\nFund shall be allocated by the Oklahoma Department of Transportation\n\nonly to municipalities having a population of less than fifteen\n\nthousand (15,000) persons according to the Federal Decennial Census\n\nor most recent population estimate to repair damage to municipal\n\nroads caused by or reasonably caused by increased use of such roads\n\nresulting from oil or gas drilling activity. The damage may be\n\nattributable to traffic associated with exploration and drilling\n\nactivity, completion of an oil or gas well, production from an oil\n\nor gas well, servicing during the period of production, repairs or\n\nother necessary activity associated with the drilling or production\n\nactivity, and other actions necessary for the operation or cessation\n\nof drilling or production activities.\n\nB. A municipality seeking funds for distribution pursuant to\n\nthe provisions of Section 2 of this act and this section shall make\n\napplication to the Oklahoma Department of Transportation on such\n\nforms as may be prescribed by the Department for such purpose. The\n\ninitial application shall be filed not later than May 1, 2023.\n\nC. A municipality shall be required to provide twenty-five\n\npercent (25%) of the total project costs in order to be eligible for\n\ndistribution of funds from the Municipal Road Drilling Activity\n\nRevolving Fund.\n\nD. The Department shall review applications in the order in\n\nwhich they are received and shall make distribution of funds based\n\non analysis of considerations of public safety, volume of traffic\n\nwhich contributes to the need for repairs, and such other factors as\n\nthe Department may determine to be relevant. The initial\n\ndistribution of funds shall take place not later than October 1,\n\n2023.\n\nE. If the Department determines that the damage to a road has\n\nbeen caused or reasonably has been caused by increased traffic\n\nrelated to oil and gas drilling or production activity as provided\n\nby this section, the Department shall transfer the eligible amount\n\nof funds to the municipality for deposit into the municipal general\n\nfund or such other public fund as the municipality shall specify in\n\nits application.\n\nF. Funds distributed pursuant to the provisions of this section\n\nshall only be used by a municipality for the repair of roads\n\naccording to the requirements of this act and shall not be used to\n\nconstruct a new road unless the damage to an existing road has\n\nbecome extensive enough to require such replacement.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"175a11a0999a07c06fb5e180b011018c0221e202b935bf8adc9ebcea131de97d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-37-501","next":"us-ok/okla.-stat.-tit.-11-11-38-101"},"notice":"GroundRules: Original legal text.
