For area within the boundary of a city, a petition shall be\n\nfiled with the city clerk. The petition shall state in bold,\n\ncapitalized letters at the top of the page that the cost of the\n\nproposed improvements shall be assessed against the property\n\nbenefited by the improvements. In addition, the petition shall be\n\nin a format which:\n\n1. Sets forth:\n\na. the general nature of the improvements to be made,\n\nb. the estimated or probable cost of the proposal,\n\nc. the area of the proposed district to be assessed,\n\nd. the proposed method of assessment, and\n\ne. the proposed apportionment of cost, if any, between\n\nthe district and the city at large; and\n\n2. Is signed by:\n\na. a majority of the resident owners of record of\n\nproperty liable for assessment under the proposal, or\n\nb. the resident owners of record of more than one-half\n\n(1/2) of the area liable for assessment under the\n\nproposal, or\n\nc. the owners of record of more than one-half (1/2) of\n\nthe area liable to be assessed under the proposal.\n\nB. For area outside the boundary of a city, a petition shall be\n\nfiled with the city clerk which:\n\n1. Sets forth:\n\na. the general nature of the improvements to be made,\n\nb. the estimated or probable cost of the proposal,\n\nc. the area of the proposed district to be assessed,\n\nd. the proposed method of assessment,\n\ne. the proposed apportionment of cost, if any, between\n\nthe district and the city at large; and\n\n2. Is signed by:\n\na. a majority of the resident owners of record of\n\nproperty liable for assessment under the proposal, and\n\nb. the owners of record of more than one-half (1/2) of\n\nthe area liable for assessment under the proposal; and\n\n3. States the area is contiguous to, but not within, the\n\nboundary of the city.\n\nC. Whenever the governing body, either upon its own initiative\n\nor in response to a petition, determines that the creation of the\n\ndistrict is necessary, it may by resolution direct the engineer to\n\nprepare preliminary plans and an estimate of cost for the proposed\n\ndistrict. The resolution shall:\n\n1. Describe in general terms the property to be included in the\n\ndistrict;\n\n2. Require the engineer to prepare:\n\na. an assessment plat showing the area to be included in\n\nthe improvement district, and\n\nb. an addendum to the assessment plat showing the amount\n\nof maximum benefit estimated to be assessed against\n\neach tract or parcel in the district on a front-foot,\n\nzone, area or other equitable basis, which basis shall\n\nbe set forth in the resolution; and\n\n3. Require the engineer to prepare preliminary plans for one or\n\nmore types of improvement showing:\n\na. for each type of curb, gutter, sidewalk and street, a\n\ntypical section of the contemplated improvement, the\n\ntype of material to be used and the approximate\n\nthickness and width of the material,\n\nb. for each type of storm sewer or drain, sanitary sewer\n\nor water line, the type of material and approximate\n\ndiameter or diameters of any trunk lines, mains,\n\nlaterals or house connections, or\n\nc. for each other type of improvement or other major\n\ncomponent of the foregoing types of improvements, a\n\ngeneral description.\n\nD. The engineer shall include in the total cost estimate for\n\nthe district all expenses including but not limited to advertising,\n\nlegal, appraising, engineering and printing expenses which the\n\nengineer deems necessary to pay the complete cost of the\n\nimprovement.\n\nE. The engineer shall submit to the city clerk the:\n\n1. Assessment plat;\n\n2. Preliminary plans of the type of construction; and\n\n3. Estimate of costs for the improvement.\n\nF. After the governing body examines the assessment plat,\n\npreliminary plans and estimates of cost for the district, the\n\ngoverning body may adopt a resolution which:\n\n1. Proposes that the district be created and the improvement be\n\nconstructed; and\n\n2.
