Stat. tit. 11, § 11-39-109","heading":"Award of contract - Payment of contractor","body":"After the governing body creates a district, the governing body\n\nmay proceed, either to make the improvement by force accounting, or\n\ncall for sealed bids on the proposed improvement, or where the\n\ndistrict comprises land owned by a single party, developer, or other\n\nlegal entity that has petitioned for the creation of the district,\n\ncontract with that single party, developer or other legal entity to\n\nmake the improvement for future dedication or other conveyance to\n\nthe city; provided, however, in the case of the districts created\n\npursuant to Section 39-103.1 of this title and except as otherwise\n\nprovided in this section, the governing body may contract for said\n\nservices without calling for sealed bids or force accounting. The\n\nnotice shall state the manner of payment to the contractor and\n\nwhether the contractor will be paid in money, in bonds or in a\n\nproportion of money and bonds for making the improvement. The\n\ngoverning body may to the extent that funds are available authorize\n\npayments to the contractor during the construction of the\n\nimprovement provided that the payments do not exceed the amount of\n\nwork completed and that ten percent (10%) of such payments shall be\n\nretained by the city pending final acceptance by the city of the\n\nimprovement.
