Stat. tit. 11, § 11-41-115","heading":"Correction of errors and defects in recorded plats -","body":"Procedure.\n\nA. Municipal plats or plats of additions and subdivisions which\n\nhave been erroneously described on any record in the chain of title\n\nto said plats, or are otherwise defective on their face, may be\n\ncorrected pursuant to the provisions of this section or pursuant to\n\nthe provisions of Sections 41-112 through 41-114 of this title.\n\nB. If a municipal plat or plat of an addition or subdivision\n\nwhich is executed and filed in the office of the county clerk of the\n\ncounty in which said plat is located fails to identify or correctly\n\ndescribe the land to be platted, the registered land surveyor who\n\nprepared said plat may execute a certificate stating the nature of\n\nthe error and cure said defect. The surveyor shall refer to said\n\nplat by correct page number and book in which said plat is recorded\n\nby the county clerk. Said certificate shall be dated and signed by\n\nsaid registered land surveyor.\n\nC. If the registered land surveyor who originally certified\n\nsaid plat pursuant to the provisions of Section 41-104 of this title\n\nis not available, or if said plat was not prepared by a registered\n\nland surveyor, a certificate as provided for in subsection B of this\n\nsection may be executed by any registered land surveyor, provided\n\nsaid certificate states the reasons why the registered land surveyor\n\nwho prepared the plat was not available or that said plat was not\n\noriginally prepared by a registered land surveyor.\n\nD. Prior to recording the correction certificate in the office\n\nof the county clerk of the county in which said plat is located, the\n\ncertificate shall be approved by the planning commission or other\n\ngovernmental body having jurisdiction, provided that such\n\ncertificate shall be approved by the municipal governing body if the\n\ncorrection alters or otherwise affects a right-of-way or easement of\n\nthe municipality.\n\nE. The certificate authorized by the provisions of this section\n\nshall be retained by the county clerk of the county in which said\n\nplat is located and shall be recorded as a correction in the county\n\nplat book.\n\nF. A certificate filed pursuant to the provisions of this\n\nsection shall be prima facie evidence of the statements contained in\n\nsaid certificate and shall be received into evidence for that\n\npurpose. No such certificate shall have the effect of destroying or\n\nchanging any vested rights which were acquired based upon an\n\nexisting plat despite the errors or defects contained in said plat.\n\nThe provisions of this section shall not prohibit any interested\n\nparty from commencing an action in the district court of the county\n\nin which the plat is located pursuant to the provisions of Sections\n\n41-112 through 41-114 of this title.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cd28100a92a1bbc3e2aeb8585274fdd4025e3954b34578e613a8e516bfc67742","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-41-114","next":"us-ok/okla.-stat.-tit.-11-11-42-101"},"notice":"GroundRules: Original legal text.
