Stat. tit. 11, § 11-42-102","heading":"Application by owner for vacation of platted tract,","body":"street, alley, easement or public way - Power of district court.\n\nA. If the owner of any tract of land platted for municipal\n\npurposes, or the owner of any portion of such platted tract, desires\n\nto vacate the whole or some part thereof, or desires to vacate a\n\nplatted street, alley, easement or portion thereof, the owner shall\n\nfile a verified application setting forth his current address and\n\nbriefly stating the reason for vacating, in the district court in\n\nthe county where the land is located.\n\nB. Notwithstanding provisions in subsection A of this section,\n\nif the owner of any tract of land platted for municipal purposes for\n\na public way desires to vacate some part thereof and the portion\n\nthus vacated would not obstruct the use of the balance of the tract\n\nas a street, avenue, alley, lane or thoroughfare open for public\n\nuse, and which tract after vacation would remain bounded on all\n\nsides by land platted for municipal purposes, the owner may file a\n\nverified application in the district court in the county where the\n\nproperty is located. The district court is authorized, upon\n\napplication by such owner and upon showing that previous use of the\n\ntract as a street would remain unobstructed, to alter or vacate the\n\nplatted tract or any part thereof.\n\nC. In cases where a portion of a tract is vacated but remains\n\nbounded on all sides by public ways and public grounds, title to the\n\nportion vacated shall pass to the municipality or public entity\n\ncreated by the municipality for the purpose of managing, developing,\n\nmaintaining or leasing, for any lawful purpose, public or private,\n\nthe tract so vacated.
