Stat. tit. 11, § 11-42-110","heading":"Power to close public ways or easements by ordinance -","body":"Reopening - Rights of utilities.\n\nA. The municipal governing body by ordinance may close to the\n\npublic use any public way or easement within the municipality\n\nwhenever deemed necessary or expedient. The procedure for closing a\n\npublic way or easement shall be established by ordinance or\n\nresolution adopted by the municipality.\n\nB. The municipality shall give written notice of any proposed\n\nclosing of a public way or easement to any holder of a franchise or\n\nothers determined by the governing body to have a special right or\n\nprivilege granted by ordinance or legislative enactment to use the\n\npublic way or easement at least thirty (30) days prior to passage of\n\nany ordinance providing for closing of a public way or easement.\n\nC. The municipality shall retain the absolute right to reopen\n\nthe public way or easement without expense to the municipality. The\n\npublic way or easement may be reopened by ordinance whenever:\n\n1. The municipal governing body deems it necessary; or\n\n2. An application of the property owners owning more than one-\n\nhalf in area of the property abutting on the public way or easement\n\npreviously closed is filed with the governing body.\n\nD.
