Stat. tit. 11, § 11-43-101.1","heading":"Restriction of use of or prohibition of future use of","body":"property within certain military installation areas.\n\nA. Any municipality in this state that is wholly or in part\n\nwithin an Air Installation Compatible Use Zone (AICUZ) study area,\n\nJoint Land Use Study (JLUS) area, Army Compatible Use Buffer (ACUB),\n\nor an Environmental Noise Management Plan (ENMP) of an active duty,\n\nNational Guard or Reserve military installation may enact a city\n\nordinance restricting or prohibiting future uses for that\n\nincorporated area which lies within the AICUZ, JLUS, ACUB, or ENMP\n\narea and which may expose residents to noise greater than sixty-five\n\n(65) Day-Night Noise Level (DNL) or accident potential that could\n\naffect the public health, safety, and welfare, or interfere with\n\nmilitary operations, including aircraft operations. Such authority\n\nshall not extend into the corporate limits of another municipality.\n\nB. The ordinance shall restrict or prohibit future uses within\n\nthe AICUZ or JLUS area which:\n\n1. Release into the air any substance which would impair\n\nvisibility or otherwise interfere with military operations,\n\nincluding ground operations, such as steam, dust or smoke unless the\n\nsubstance is generated from agricultural use;\n\n2. Produce light emissions, either directly, or indirectly or\n\nby reflective light, which would interfere with pilot vision, and\n\naerial or ground-based night vision training;\n\n3. Produce electrical emissions which would interfere with\n\nmilitary ground and aircraft communications and navigation\n\nequipment;\n\n4. Attract birds or waterfowl including, but not limited to,\n\noperation of sanitary landfills and maintenance of feeding stations;\n\n5. Provide for structures within ten (10) feet of defined\n\naircraft approach, departure, or transitional surfaces; or one\n\nhundred (100) feet beneath a low-level military aircraft training\n\nroute as provided by the Federal Aviation Administration;\n\n6. Expose persons to noise greater than sixty-five (65) DNL; or\n\n7. Detract from the aesthetic appearance, or otherwise create\n\nor promote an unsightly, unsanitary or unhealthy appearance of any\n\nentrance into a military installation including, but not limited to,\n\nautomobile or truck salvage yards, equipment storage sites or solid\n\nwaste storage or disposal sites.\n\nC. The ordinance shall restrict or prohibit future uses within\n\nthe AICUZ/JLUS area which violate any Federal Aviation\n\nAdministration height restriction in Title 14 of the Code of Federal\n\nRegulations (14 CFR) part 77, Objects Affecting Navigable Airspace.\n\nD. 1. The ordinance shall be consistent with the most current\n\nrecommendations or studies made by the United States Air Force\n\ninstallations located at Altus Air Force Base located in Altus,\n\nOklahoma, Tinker Air Force Base located in Oklahoma City, Oklahoma,\n\nand Vance Air Force Base located in Enid, Oklahoma, entitled “Air\n\nInstallation Compatible Use Zone Study” or studies made by the\n\nUnited States Department of the Army installations located at Fort\n\nSill in Lawton, Oklahoma, entitled “Army Compatible Use Buffers” or\n\nany similar zoning relating to or surrounding a military\n\ninstallation as adopted by a county, city, or town or any\n\ncombination of those governmental entities and shall be consistent\n\nwith the most current recommendations; and\n\n2. Interpretations of such ordinance shall consider the\n\nrecommendations or studies with a view to protection of the public\n\nhealth, safety, and welfare and maintenance of safe military and\n\naircraft operations, and assure sustainability of installation\n\nmissions.\n\nE. Subject to the provisions and requirements of paragraph 1 of\n\nsubsection D of this section, the ordinance shall not prohibit\n\nsingle-family residential use on tracts of one (1) acre or more in\n\narea, provided that future construction shall comply with the\n\n“Guidelines for the Sound Insulation of Residences Exposed to\n\nAircraft Operations, Wyle Research Report WR 89-7\". Such\nallation\n\nmissions.\n\nE. Subject to the provisions and requirements of paragraph 1 of\n\nsubsection D of this section, the ordinance shall not prohibit\n\nsingle-family residential use on tracts of one (1) acre or more in\n\narea, provided that future construction shall comply with the\n\n“Guidelines for the Sound Insulation of Residences Exposed to\n\nAircraft Operations, Wyle Research Report WR 89-7\".
