Stat. tit. 11, § 11-43-109.3","heading":"Limits on municipal regulations for single-family","body":"residential building design elements – Rights of private parties.\n\nA. Beginning on and after the effective date of this act, a\n\nmunicipality, city or town shall not adopt or impose new single-\n\nfamily residential building design elements or implement new\n\npolicies that have the effect of creating new single-family\n\nresidential building design element regulations, unless:\n\n1. The residential building structure is:\n\na. located in an area formally designated and declared as\n\na state or local historic district under applicable\n\nlaw,\n\nb. designated as a local, state or national historic\n\nlandmark,\n\nc. located on a property that is governed by a regulation\n\ncreated by any valid negotiated zoning ordinance which\n\nserves to indicate mutual consent between property\n\nowners and a municipality, city or town, which\n\nincludes but is not limited to a Planned Unit\n\nDevelopment,\n\nd. located on a property that is governed by the\n\napplication of a municipal, city, or town policy,\n\nregulation or ordinance affecting the public safety of\n\nresidential building design elements and such policy,\n\nregulation or ordinance was duly and properly adopted\n\nby the applicable governing body in accordance with\n\napplicable law,\n\ne. located on a property that is governed by a policy or\n\nregulation as set forth within a duly adopted tax\n\nincrement finance district or a business improvement\n\ndistrict,\n\nf. located on a property that is governed by a policy or\n\nregulation of an overlay or a special purpose zoning\n\ndistrict that is adopted pursuant to applicable law,\n\nor\n\ng. located in an existing neighborhood designated as a\n\nblighted area or redevelopment district; or\n\n2. The regulations are:\n\na. directly and substantially related to life safety or\n\nbuilding safety, or\n\nb. applied to manufactured housing in a manner consistent\n\nwith applicable state or federal law, or\n\nc. adopted as a condition for participation in the\n\nNational Flood Insurance Program.\n\nB. As used in this section:\n\n1. \"Residential building design elements\" means:\n\na. type or style of exterior cladding or finish\n\nmaterials,\n\nb. style or materials of roof structures, roof pitches or\n\nporches,\n\nc. exterior nonstructural architectural ornamentation,\n\nd. location, design, placement or architectural styling\n\nof windows and doors including garage doors and garage\n\nstructures,\n\ne. the number and types of rooms,\n\nf. the interior layout of rooms, and\n\ng. the minimum square footage of a structure; and\n\n2. \"Residential building design elements\" does not include:\n\na. the height, bulk, orientation or location of a\n\nstructure on a lot, or\n\nb. buffering or screening elements located at the\n\nperimeter of the property that are used to:\n\n(1) minimize visual impacts,\n\n(2) mitigate the impacts of light and noise, or\n\n(3) protect the privacy of neighbors.\n\nC. This section does not prohibit or diminish the rights of\n\nprivate parties to enact regulations as created by valid private\n\ncovenants or other contractual agreements among property owners\n\nrelating to residential building design elements including\n\nrestrictive covenants and declarations such as those maintained by\n\nowners' associations in real estate developments as created under\n\nSection 851 et seq. of Title 60 of the Oklahoma Statutes or under\n\nSection 501 et seq. of Title 60 of the Oklahoma Statutes.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3d7693238a034109f3f0b0e3d2ba5ccd5fece2e88384d471f6647b9f8059a1c7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-43-109.2","next":"us-ok/okla.-stat.-tit.-11-11-43-110"},"notice":"GroundRules: Original legal text.
