Any individual who was a member with a vested benefit with\n\nthe Oklahoma Police Pension and Retirement System on or after July\n\n1, 1987, and who becomes appointed to a position in the Oklahoma\n\nState Bureau of Narcotics and Dangerous Drugs Control, the Oklahoma\n\nState Bureau of Investigation, or the Alcoholic Beverage Laws\n\nEnforcement Commission may, at the time the individual accepts such\n\nposition, elect in writing to remain a member of the Oklahoma Police\n\nPension and Retirement System as long as the individual has not\n\nbegun receiving benefits from the Oklahoma Police Pension and\n\nRetirement System or the Oklahoma Law Enforcement Retirement System\n\nand shall not become a member of the Oklahoma Law Enforcement\n\nRetirement System. The agency shall send a copy of the written\n\nelection to the Oklahoma Police Pension and Retirement System and\n\nthe Oklahoma Law Enforcement Retirement System within five (5)\n\nbusiness days from its signing. If such eligible individual does\n\nnot elect to remain in the Oklahoma Police Pension and Retirement\n\nSystem pursuant to this subsection, then the individual may elect to\n\ntransfer at a later date pursuant to subsection B of this section.\n\nB. Any individual who was a member with a vested benefit with\n\nthe Oklahoma Police Pension and Retirement System on or after July\n\n1, 1987, and who subsequently entered the Oklahoma Law Enforcement\n\nRetirement System because he or she was appointed to a position in\n\nthe Oklahoma State Bureau of Narcotics and Dangerous Drugs Control,\n\nthe Oklahoma State Bureau of Investigation, or the Alcoholic\n\nBeverage Laws Enforcement Commission or, effective July 1, 2013,\n\nthrough July 31, 2013, an individual who made an election under\n\nsubsection A that had been accepted by the Oklahoma Police Pension\n\nand Retirement System who did not have a vested benefit may, at any\n\ntime the member is an active employee of such agency and has not\n\nbegun receiving benefits from the Oklahoma Police Pension and\n\nRetirement System or the Oklahoma Law Enforcement Retirement System,\n\nelect in writing to reenter the Oklahoma Police Pension and\n\nRetirement System. Such written election shall be provided to the\n\nOklahoma Police Pension and Retirement System. For purposes of this\n\nsection, constructive receipt of the written election shall be the\n\nfirst day of the month following actual receipt.\n\n1. A person who elects to transfer pursuant to this subsection\n\nshall have all of his or her employer and employee contributions\n\nmade to the Oklahoma Law Enforcement Retirement System transferred\n\nto the Oklahoma Police Pension and Retirement System along with\n\naccrued earnings based upon the actuarial rate of return of the\n\nOklahoma Law Enforcement Retirement System. Upon receiving the\n\ntransfer of the employer and employee contributions and earnings,\n\nand notwithstanding the provisions of Section 50-111.4 of this\n\ntitle, the Oklahoma Police Pension and Retirement System shall treat\n\nthe service that the member accrued in the Oklahoma Law Enforcement\n\nRetirement System as service in the Oklahoma Police Pension and\n\nRetirement System; and\n\n2. Upon actual receipt of the written election pursuant to this\n\nsubsection, the Oklahoma Police Pension and Retirement System shall\n\nnotify the Oklahoma Law Enforcement Retirement System of the\n\ntransfer election and shall send to the Oklahoma Law Enforcement\n\nRetirement System a copy of the election within five (5) business\n\ndays. The Oklahoma Law Enforcement Retirement System shall transfer\n\nthe employer and employee contributions and earnings of the\n\ntransferring member to the Oklahoma Police Pension and Retirement\n\nSystem on or before the first day of the month following\n\nconstructive receipt of the election. The transferring member shall\n\nthen reenter the Oklahoma Police Pension and Retirement System\n(5) business\n\ndays. The Oklahoma Law Enforcement Retirement System shall transfer\n\nthe employer and employee contributions and earnings of the\n\ntransferring member to the Oklahoma Police Pension and Retirement\n\nSystem on or before the first day of the month following\n\nconstructive receipt of the election. The transferring member shall\n\nthen reenter the Oklahoma Police Pension and Retirement System\n\nbeginning on the first day of the month following the month in which\n\nconstructive receipt of the written election was made to the\n\nOklahoma Police Pension and Retirement System. Any member who\n\ntransfers to the Oklahoma Police Pension and Retirement System\n\npursuant to this subsection shall have all service credit in the\n\nOklahoma Law Enforcement Retirement System canceled.\n\nC. Notwithstanding the provisions of Section 2-300 et seq. of\n\nTitle 47 of the Oklahoma Statutes, the Oklahoma State Bureau of\n\nNarcotics and Dangerous Drugs Control, the Oklahoma State Bureau of\n\nInvestigation, and the Alcoholic Beverage Laws Enforcement\n\nCommission shall make employer contributions to the Oklahoma Police\n\nPension and Retirement System in the same manner as participating\n\nmunicipalities of the Oklahoma Police Pension and Retirement System\n\nfor all members who either elect to remain in or elect to transfer\n\nto the Oklahoma Police Pension and Retirement System pursuant to\n\nthis section.
