All persons employed as full-time duly appointed or elected\n\nofficers who are paid for working more than twenty-five (25) hours\n\nper week or any person hired by a participating municipality who is\n\nundergoing police training to become a permanent police officer of\n\nthe municipality shall participate in the System upon initial\n\nemployment with a police department of a participating municipality.\n\nAll such persons shall submit to a physical-medical examination\n\npertaining to sight, hearing, agility and other conditions the\n\nrequirements of which shall be established by the State Board. The\n\nperson shall be required to complete this physical-medical\n\nexamination prior to the beginning of actual employment. This\n\nexamination shall identify any preexisting conditions. Except as\n\notherwise provided in this section, a police officer shall be not\n\nless than twenty-one (21) nor more than forty-five (45) years of age\n\nwhen accepted for membership in the System. However, if a\n\nmunicipality should be found to be in noncompliance with the\n\nprovisions of Article 50 of this title, as determined by the State\n\nBoard, then any current full-time active police officer employed by\n\na municipality as of July 1, 2001, shall not be denied eligibility\n\nto participate in the Oklahoma Police Pension and Retirement System\n\nsolely due to age. The State Board shall have authority to deny or\n\nrevoke membership of any person submitting false information in such\n\nperson's membership application. The State Board shall have final\n\nauthority in determining eligibility for membership in the System,\n\npursuant to the provisions of this article.\n\nB. The police chief of any participating municipality may be\n\nexempt from membership in the System or may become a member provided\n\nthe member is not a retired member and the requirements of this\n\nsection are met at the time of employment.\n\nC. A member of the System who has attained his or her normal\n\nretirement date may, if the member so elects, agree to terminate\n\nemployment and retire as a member of the System and make an election\n\nto receive distributions from the System. If a retired member is\n\nreemployed by a participating municipality in the position of police\n\nchief or in a position which is not covered by the System,\n\nretirement shall include receipt by such retired member of in-\n\nservice distributions from the System.\n\nD. A former member of the System who terminates from covered\n\nemployment and who has neither retired from the System nor entered\n\nthe Oklahoma Police Deferred Option Plan and is later employed in a\n\ncovered position with a participating municipality shall not be\n\ndenied eligibility to become a member of the System because he or\n\nshe is forty-five (45) years of age or older. If such member has\n\nwithdrawn his or her contributions prior to re-entering the System\n\nand the member desires to receive credit for such prior service,\n\nthen the member shall pay back such contributions and interest\n\npursuant to Section 50-111.1 of this title.\n\nE. Notwithstanding any other provision of law to the contrary,\n\na municipality that employs two (2) or fewer full-time police\n\nofficers may employ a police officer who is more than forty-five\n\n(45) years of age and who has never participated in the Oklahoma\n\nPolice Pension and Retirement System, but such police officer shall\n\nnot be eligible to participate in the System.
