The State Board is authorized to pay a pension to the\n\nbeneficiary of any member where requirements for eligibility for\n\nsuch pension are met as provided in this subsection. The pension\n\nshall be in an amount as the State Board shall provide not exceeding\n\nthe accrued retirement benefit or normal disability benefit. Before\n\nany beneficiary of a member shall be entitled to any pension the\n\nmember must have complied with any agreement as to contributions by\n\nthe member and other members to the System where said agreement has\n\nbeen made as provided by this article, and the State Board must find\n\nthat:\n\n1. The member lost his or her life while in, and in consequence\n\nof, the performance of the member’s duty and through no negligence\n\non the member’s part; and\n\n2. The member left a beneficiary.\n\nB. The State Board is authorized to pay a pension to the\n\nbeneficiary of any member where requirements for eligibility for\n\nsuch pension are met as provided in this subsection. The member’s\n\nbeneficiary shall receive the member’s accrued retirement benefit.\n\nBefore any beneficiary of a member shall be entitled to any pension\n\nthe member must have complied with any agreement as to contributions\n\nby the member and other members to the System where said agreement\n\nhas been made as provided by this article, and the State Board must\n\nfind that:\n\n1. The member completed ten (10) years of credited service and\n\ndied from any cause; and\n\n2. The member left a beneficiary.\n\nC. If such finding is made, a pension shall be allowed, limited\n\nas provided in this article. The pension shall commence to the\n\nbeneficiary of the member within one (1) year of the death of the\n\nmember and, except as otherwise provided in this section, shall be\n\npayable over the life of the beneficiary. If the beneficiary is a\n\nchild of the member, the pension payments shall cease automatically\n\nwhen the child reaches eighteen (18) years of age or twenty-two (22)\n\nyears of age if the child is enrolled full time and regularly\n\nattending a public or private school or any institution of higher\n\neducation.\n\nIf the beneficiary is a surviving spouse of a member who\n\nremarried prior to June 7, 1993, and was a surviving spouse of a\n\nmember who died while in, or as a consequence of, the performance of\n\nthe member’s duty for the employer, the surviving spouse shall be\n\neligible to receive the pension benefits provided for in this\n\nsection. To receive the pension benefits provided for in this\n\nsection the surviving spouse falling within this section shall\n\nsubmit a written request for such benefits to the Oklahoma Police\n\nPension and Retirement System. The Oklahoma Police Pension and\n\nRetirement System shall approve requests by surviving spouses\n\nmeeting the requirements of this section. Upon approval by the\n\nOklahoma Police Pension and Retirement System, the surviving spouse\n\nshall be entitled to the pension benefits provided for in this\n\nsection beginning from the date of approval forward. Pension\n\nbenefits provided to surviving spouses falling within this section\n\nshall not apply to alter any amount of pension benefits paid or due\n\nprior to the Oklahoma Police Pension and Retirement System’s\n\napproval of the remarried surviving spouse’s written request for\n\nbenefits.\n\nNo surviving spouse shall receive benefits from this section,\n\nSection 49-113 of this title, or Section 2-306 of Title 47 as the\n\nsurviving spouse of more than one member of the Oklahoma\n\nFirefighters Pension and Retirement System, the Oklahoma Police\n\nPension and Retirement System, or the Oklahoma Law Enforcement\n\nRetirement System.
