Stat. tit. 11, § 11-50-123","heading":"Discharge of member - Board of review - Grounds -","body":"Appeal.\n\nA. The governing body of every participating municipality,\n\nexcept municipalities which have provided for a civil service board\n\nof review or merit board, or have negotiated a contract covering\n\ndischarge with their members to hear such appeals, shall establish a\n\nboard of review to hear appeals concerning the discharge of members.\n\nThe board of review shall consist of the mayor, ex officio, who\n\nshall be a voting member, and four members to be appointed by the\n\ngoverning body of the participating municipality, as follows:\n\n1. Two police officers retired or active from the police\n\ndepartment of the municipality; and\n\n2. One attorney and one licensed physician residing in the\n\nmunicipality.\n\nWhenever persons meeting the qualifications of this subsection are\n\nunavailable for appointments, the mayor shall in lieu thereof make\n\nthe appointments from the governing body of the municipality, except\n\nthat neither the Chief of Police nor any person having direct\n\nappointive authority for police personnel shall be eligible for\n\nappointment to said board. Appointive members of the board shall\n\nserve at the pleasure of the appointing official.\n\nB. No member may be discharged except for cause. Any member\n\nwho is discharged may appeal to the board of review herein provided.\n\nAppeals from decisions of said board of review may be taken in the\n\nmanner provided for in this article, provided the provisions of this\n\nsection relating to the board of review and discharge shall not\n\napply to any municipality which has heretofore or hereinafter\n\nestablished by its charter civil service or merit system pertaining\n\nto the appointment and discharge of members and an independent board\n\nor commission having authority to hear actions involving the\n\ndischarge of members.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ce15d715a443c1cad5f802fd99491b7f0339b1ef51c41e82b6eb1d950d59d16e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-50-122","next":"us-ok/okla.-stat.-tit.-11-11-50-124"},"notice":"GroundRules: Original legal text.
