Stat. tit. 11, § 11-51-102","heading":"Definitions","body":"As used in this article, unless the context requires a different\n\ninterpretation:\n\n1. \"Fire fighters and police officers\" shall mean the permanent\n\npaid members of any fire department or police department in any\n\nmunicipality within the State of Oklahoma but shall not include the\n\nchief of police and an administrative assistant and the chief of the\n\nfire department and an administrative assistant. The administrative\n\nassistant shall be that person so designated by the chief of the\n\npolice department. \"Police officers\" as used herein shall be those\n\npersons as defined in Section 50-101 of this title.\n\n2. \"Corporate authorities\" means the proper officials, singly\n\nor collectively, within any municipality whose duty or duties it is\n\nto establish the wages, salaries, rates of pay, hours, working\n\nconditions and other terms and conditions of employment of fire\n\nfighters or police officers, whether they be the mayor, city\n\nmanager, town manager, town administrator, city council, town\n\ncouncil, director of personnel, personnel board or commission, or by\n\nwhatever other name the same may be designated, or any combination\n\nthereof. It is not the intent of this paragraph that the above-\n\nnamed officials shall in any way be exclusive or limiting.\n\n3. \"Strike\" shall mean the concerted failure to report for\n\nduty, the willful absence from one's position, unauthorized\n\nholidays, sickness unsubstantiated by a physician's statement, the\n\nstoppage of work, or the abstinence in whole or in part from the\n\nfull, faithful and proper performance of the duties of employment,\n\nfor the purpose of inducing, influencing or coercing a change in the\n\nconditions, compensation, rights, privileges or obligations of\n\nemployment. Nothing contained in this article shall be construed to\n\nlimit, impair or affect the right of any public employee to the\n\nexpression or communication of a view, grievance, complaint or\n\nopinion on any matter related to the conditions or compensation of\n\npublic employment or their betterment, so long as the same does not\n\ninterfere with the full, faithful and proper performance of the\n\nduties of employment.\n\n4. \"Bargaining agent\" shall mean any lawful association,\n\nfraternal organization, labor organization, federation or council\n\nhaving as one of its purposes the improvement of wages, hours and\n\nother conditions of employment among employees of fire and police\n\ndepartments.\n\n5. \"Collective bargaining\" shall mean the performance of the\n\nmutual obligation of the municipal employer or his designated\n\nrepresentatives and the representative of the employees to meet at\n\nreasonable times, including meetings appropriately related to the\n\nbudget-making process; to confer in good faith with respect to\n\nwages, hours and other conditions of employment, or the negotiation\n\nof an agreement, or any question arising thereunder; and to execute\n\na written contract incorporating any agreement reached if requested\n\nby either party. Such obligation shall not, however, compel either\n\nparty to agree to a proposal or require the making of a concession.\n\n6. \"Unfair labor practices\" for the purpose of this article\n\nshall be deemed to include but not be limited to the following acts\n\nand conduct:\n\n6a. Action by corporate authorities:\n\n(1) interfering with, restraining, intimidating or\n\ncoercing employees in the exercise of the rights\n\nguaranteed them by this article;\n\n(2) dominating or interfering with the formation,\n\nexistence or administration of any employee\n\norganization or bargaining agent;\n\n(3) interfering in any manner whatsoever with the\n\nprocess of selection by fire fighters or police\n\nofficers of their respective bargaining agents or\n\nattempting to influence, coerce or intimidate\n\nindividuals in such selection;\nights\n\nguaranteed them by this article;\n\n(2) dominating or interfering with the formation,\n\nexistence or administration of any employee\n\norganization or bargaining agent;\n\n(3) interfering in any manner whatsoever with the\n\nprocess of selection by fire fighters or police\n\nofficers of their respective bargaining agents or\n\nattempting to influence, coerce or intimidate\n\nindividuals in such selection;\n\n(4) discharging or otherwise disciplining or\n\ndiscriminating against a police officer or fire\n\nfighter because he has signed or filed any\n\naffidavit, petition or complaint or has given any\n\ninformation or testimony under this article or\n\nbecause of his election to be represented by the\n\nbargaining agent;\n\n(5) refusing to bargain collectively or discuss\n\ngrievances in good faith with the designated\n\nbargaining agent with respect to any issue coming\n\nwithin the purview of this article; or\n\n(6) instituting or attempting to institute a lockout.\n\n6b. Action by bargaining agent:\n\n(1) interfering with, restraining, intimidating or\n\ncoercing employees in the exercise of the rights\n\nguaranteed them by this article;\n\n(2) interfering with or attempting to coerce the\n\ncorporate authorities in the selection of their\n\nrepresentatives for the purposes of collective\n\nbargaining or the adjustment of grievances; or\n\n(3) refusing to bargain collectively or discuss\n\ngrievances in good faith with the proper\n\ncorporate authorities with respect to any issue\n\ncoming within the purview of this article.\n\n7. \"Board\" shall mean the Public Employees Relations Board.","path":["OK Code","Title 11"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os11.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"621ba013ed2afdd23d5a9607c9f1c06de909d38d7e22ffd0ba8b0aae0359b251","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-11-11-51-101","next":"us-ok/okla.-stat.-tit.-11-11-51-103"},"notice":"GroundRules: Original legal text.
