Firefighters and police officers in any municipality shall\n\nhave the separate right to bargain collectively with their\n\nmunicipality and to be represented by a bargaining agent in such\n\ncollective bargaining with respect to wages, salaries, hours, rates\n\nof pay, grievances, working conditions and all other terms and\n\nconditions of employment.\n\nB. A municipal employer shall recognize a bargaining agent\n\nselected by a majority of the firefighters of the fire department or\n\npolice officers of the police department of that municipality as the\n\nexclusive bargaining agent for the firefighters or police officers\n\nof that municipality until a majority of the firefighters or police\n\nofficers withdraw the recognition. Bargaining agents recognized by\n\nmunicipalities and having bargained with municipalities, prior to\n\nthe effective date of this act, shall continue to be so recognized\n\nwithout a new selection by the majority of the firefighters or\n\npolice officers.\n\n1. The bargaining agent representing the department as the\n\nexclusive bargaining agent shall be determined by a majority vote of\n\nthe police or firefighters of the department.\n\n2. A question of whether a bargaining agent is the exclusive\n\nbargaining agent of the respective police or firefighters of a\n\ndepartment shall be resolved by a fair election paid for by the\n\nbargaining agent or employees and conducted according to procedures\n\nagreed on by the parties. Such question arises where no bargaining\n\nagent is currently recognized as a bargaining agent or where a\n\nbargaining agent is recognized and another bargaining agent presents\n\nproof they represent at least forty percent (40%) of the respective\n\npolice or firefighters of a department.\n\nAny vote or ballot authorized by the agreed procedures shall be\n\naccompanied by a copy of the voter's driver license or other state-\n\nauthorized identification card, and any vote or ballot submitted in\n\nperson shall only be received by providing the same. The bargaining\n\nagent seeking to represent the members of the department and the\n\nmunicipality shall each be entitled to select one person to observe\n\nthe counting and tabulating of ballots cast in the election.\n\n3. If the parties are unable to agree on election procedures\n\nunder paragraph 2 of this subsection, either party may request the\n\nAmerican Arbitration Association to conduct the election and certify\n\nthe results. Certification of the results of an election under this\n\nparagraph shall resolve the question regarding representation. Any\n\nexpenses of the election imposed by the American Arbitration\n\nAssociation shall be borne in equal shares by both parties, except\n\nthat, if any fraudulent activity occurs in the election procedures\n\nor in tabulating the votes, the offending party shall solely bear\n\nthe expense.\n\n4.
