Stat. tit. 11, § 11-8-112","heading":"Resignation of municipal officer","body":"A municipal officer may resign by submitting his written\n\nresignation to the governing body of the municipality, to the\n\nremaining members of the municipal governing body if some positions\n\nare vacant, to the interim mayor or, if all positions of the\n\ngoverning body will become vacant upon the resignation, to the board\n\nof county commissioners of the county in which the municipality is\n\nlocated. Delivery of the written resignation to the governing body\n\nduring a public meeting of such body or to the municipal clerk by\n\nmail or personal delivery during regular office hours shall\n\nconstitute submission of the resignation to the municipal governing\n\nbody. Delivery of the written resignation to the board of county\n\ncommissioners during a public meeting of the commissioners or to the\n\ncounty clerk by mail or hand delivery during regular office hours\n\nshall constitute submission of the resignation to the board of\n\ncounty commissioners. A resignation submitted by a municipal\n\nofficer may be withdrawn in writing at any time prior to the\n\neffective date stated in the resignation. If no effective date is\n\nstated, the resignation shall be effective immediately.
