Stat. tit. 12, § 12-1103","heading":"Submission of controversy without suit","body":"Parties to a question, which might be the subject of a civil\n\naction, may, without action, agree upon a case containing the facts\n\nupon which the controversy depends, and present a submission of the\n\nsame to any court, which would have jurisdiction if an action had\n\nbeen brought. But it must appear, by affidavit, that the\n\ncontroversy is real, and the proceedings in good faith to determine\n\nthe rights of the parties.
