Stat. tit. 12, § 12-1141.2","heading":"Definitions","body":"As used in this act:\n\n1. “Apparent cloud” means an effect, without a judgment of a\n\ncourt of competent jurisdiction, which in the good faith opinion of\n\na requestor results in a condition of title to real property located\n\nin the State of Oklahoma that fails to meet the standard of\n\n“marketable title” as defined by the “Oklahoma Title Examination\n\nStandards” as adopted and revised by the House of Delegates of the\n\nOklahoma Bar Association;\n\n2. “Certified mail” means that method of transmitting items\n\nthrough the United States Post Office pursuant to which the\n\naddressee of the item mailed is either required to indicate an\n\nacceptance of delivery or refusal or which results in a record by\n\nthe United States Post Office that the addressee was contacted\n\nregarding the item, but refused delivery or refused to claim the\n\nitem;\n\n3. “Conveyance” means an instrument, recorded in the real\n\nproperty records of a county of the State of Oklahoma, pursuant to\n\nwhich a grantor makes a transfer of an estate in real property;\n\n4. “Corrective action” means some procedure, other than the\n\nexecution and delivery of a curative instrument, identified in a\n\nnotice and communicated to a respondent with the intended effect of\n\nremoving a cloud or an apparent cloud on the title to real property;\n\n5. “Curative instrument” means a conveyance or instrument\n\nidentified by a requestor that the requestor in good faith believes\n\nhas the effect of curing a title defect;\n\n6. “Entity” means a person, firm, partnership, general\n\npartnership, limited partnership, corporation, limited liability\n\ncompany, limited liability partnership or other legally constituted\n\nentity;\n\n7. “Estate” means a quantity or duration of ownership in real\n\nproperty located in the State of Oklahoma whether in fee simple\n\nabsolute or some lesser quantity or duration and includes both the\n\nsurface estate and mineral estate;\n\n8. “Execute” means to subscribe an instrument or a conveyance\n\nas either a natural person acting in an individual or a\n\nrepresentative capacity;\n\n9. “Good faith” means having a basis in facts ascertainable to\n\na requestor or which should be ascertainable with the exercise of\n\nreasonable diligence and the reasonable application of law to facts\n\nknown or which, through the exercise of reasonable diligence, should\n\nbe known to a requestor regarding the effect of an instrument upon\n\nthe title to real property located in the State of Oklahoma;\n\n10. “Instrument” means a document, executed with formalities\n\nauthorized or required by law, pursuant to which either a conveyance\n\nis made or pursuant to which some aspect of the title to real\n\nproperty located in the State of Oklahoma is affected or may be\n\naffected;\n\n11. “Interest” means either legal title or an equitable claim\n\nwhich is made in good faith;\n\n12. “Notice” means the document described in Section 3 of this\n\nact;\n\n13. “Parcel” means real property capable of separate\n\ndescription from any other real property located in the State of\n\nOklahoma, pursuant to a description which is adequate for a\n\nconveyance pursuant to the requirements of the laws of the State of\n\nOklahoma;\n\n14. “Person” means a natural person acting in an individual\n\ncapacity or a natural person acting in a representative capacity;\n\n15. “Quiet title action” means a civil action filed pursuant to\n\nthe authority of Section 1141 of Title 12 of the Oklahoma Statutes\n\nand in which the plaintiff requests a determination or judgment from\n\nthe court regarding the title to a parcel of real property;\n\n16. “Real property” means land and fixtures and includes the\n\nsurface estate and the minerals underlying lands located in the\n\nState of Oklahoma;\n\n17. “Refuse” means that the respondent either will not take the\n\naction specified in a notice or that the respondent will not take\n\naction which the requestor communicates as an acceptable response to\n\nthe notice;\nhe title to a parcel of real property;\n\n16. “Real property” means land and fixtures and includes the\n\nsurface estate and the minerals underlying lands located in the\n\nState of Oklahoma;\n\n17. “Refuse” means that the respondent either will not take the\n\naction specified in a notice or that the respondent will not take\n\naction which the requestor communicates as an acceptable response to\n\nthe notice;\n\n18. “Requestor” means any person or entity transmitting a\n\nnotice to a respondent pursuant to Section 3 of this act or if the\n\nrequestor engages the services of an agent or fiduciary to prepare\n\nthe notice, the agent or fiduciary of the requestor;\n\n19. “Respondent” means the person or entity to whom a notice is\n\ntransmitted pursuant to Section 3 of this act or, if the respondent\n\nengages the services of an agent or fiduciary to prepare a response\n\nto a requestor, the agent or fiduciary of the requestor;\n\n20. “Response” means the document transmitted by the respondent\n\nto the requestor within the time prescribed by Section 4 of this\n\nact;\n\n21. “Subject parcel” means the specific real property\n\nidentified in a notice transmitted to a respondent as provided by\n\nSection 3 of this act;\n\n22. “Title” means the judicial or nonjudicial conclusion\n\nregarding either legal or equitable ownership of real property or an\n\nestate in real property located in the State of Oklahoma; and\n\n23. “Title defect” means a deficiency, as measured or\n\ndetermined by reference to the statutes of the State of Oklahoma,\n\ncases decided by the courts of the State of Oklahoma or by reference\n\nto the Title Examination Standards published by the Real Property\n\nSection of the Oklahoma Bar Association, in the legal or equitable\n\ntitle of real property located in
