Any person or any entity having an interest or claiming an\n\ninterest with respect to any parcel of real property who in good\n\nfaith asserts that there is an instrument filed in the real property\n\nrecords of the county in which the real property, or some portion of\n\nthe real property, is located and who would otherwise be required to\n\nfile a quiet title action with respect to the parcel pursuant to the\n\nprovisions of Section 1141 of Title 12 of the Oklahoma Statutes, may\n\nuse the procedures authorized by this act to attempt to remove a\n\ncloud or an apparent cloud on the title of the real property by\n\nrequesting a respondent to prepare a curative instrument or to take\n\ncorrective action.\n\nB. The provisions of this act are permissive and shall not be\n\nrequired as a condition precedent to the filing of a petition to\n\nquiet title pursuant to Section 1141 of Title 12 of the Oklahoma\n\nStatutes.\n\nC. If making a request pursuant to this act, the requestor\n\nshall send a notice to the respondent which shall include:\n\n1. The specific identity of the person or entity requesting the\n\nrespondent to execute or to execute and deliver a curative\n\ninstrument or take other corrective action the purpose of which is\n\nto remove a cloud or an apparent cloud on the title of the subject\n\nparcel;\n\n2. A specific identification of the conveyance, instrument or\n\nother document, by reference to:\n\na. the county or counties in which the instrument or\n\ndocument is filed for record,\n\nb. the book and page number in which the instrument or\n\nother document is recorded,\n\nc. the identity of the grantor or the person or entity\n\nsubscribing the instrument, (if different than the\n\nidentified grantor),\n\nd. the identity of the grantee or grantees,\n\ne. the legal description of the real property contained\n\nin the instrument,\n\nf. the date the instrument was executed,\n\ng. the date the instrument was filed for record, and\n\nh. such other information as may be required in order for\n\nthe respondent to know with reasonable certainty the\n\nexact instrument or instruments to which the requestor\n\nis referring;\n\n3. The nature of the assertion by the requestor regarding the\n\neffect of the instrument or document as a cloud or an apparent cloud\n\nupon the title of the subject parcel; and\n\n4. The nature of the corrective action sought by the requestor,\n\nincluding, but not limited to, the exact instrument or conveyance\n\nwhich the requestor would accept from the respondent as a curative\n\ninstrument or other corrective action.\n\nD.
