Stat. tit. 12, § 12-1141.4","heading":"Notice – Respondent’s request for clarification or","body":"information – Failure of respondent to deliver curative instrument\n\nor take corrective action.\n\nA. The requestor shall prepare the notice as described in\n\nSection 3 of this act and shall transmit the notice by certified\n\nmail to the person or entity identified in the notice as the\n\nrespondent.\n\nB. The respondent shall have a period of thirty (30) days from\n\nthe receipt of the notice within which to respond to the notice and\n\nany request for the execution or delivery of a curative instrument\n\nor for corrective action.\n\nC. A respondent may ask for clarification by the requestor or\n\nfor further information prior to making either a negative response\n\nor an affirmative response. The respondent may communicate with the\n\nrequestor within the period of time required for the respondent to\n\nmake a response to the requestor, but any request made pursuant to\n\nthis subsection shall not extend the time within which to respond.\n\nD. The respondent may make a formal request of the requestor\n\nfor clarification or for further information by certified mail if\n\nthe formal request for clarification or additional information is\n\nreceived by the original requestor within the original period of\n\ntime prescribed by subsection B of this section for a response by\n\nthe respondent. If a respondent makes a formal request for\n\nclarification or for additional information, the original requestor\n\nshall have a period of twenty (20) days within which to transmit a\n\nclarification or additional information. The respondent shall then\n\nhave a period of twenty (20) days from the date the clarification or\n\nadditional information is received in order to provide a final\n\nresponse.\n\nE. If a respondent declines to execute and deliver the curative\n\ninstrument requested or take the corrective action requested, and\n\nthe respondent communicates the refusal to the requestor, the\n\nrequestor may pursue the remedies authorized by this section.\n\nF. If the requestor properly transmits the notice by certified\n\nmail and the respondent does not claim the item as indicated by the\n\nrecords of the United States Post Office, the refusal to claim the\n\nitem shall be treated as a refusal to respond to the request.\n\nG. If a respondent executes and delivers or causes to be\n\nexecuted and delivered the curative instrument requested in the\n\nnotice or takes the corrective action requested, the respondent\n\nshall not be liable for the damages specified in subsection A of\n\nSection 5 of this act in a quiet title action notwithstanding that\n\nthe respondent is named as a defendant in such an action.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d61e6f6f12e6109ad7b12c2fa2eb76448d5788696aa461b658011bcd9ad2c7dd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-1141.3","next":"us-ok/okla.-stat.-tit.-12-12-1141.5"},"notice":"GroundRules: Original legal text.
